HomeMy WebLinkAbout1997-177 Promissory Note - Gross97-1S372 PROMISSORY NOTE Planning Department Fee Secured by Deed of Trust $230.00 Ashland, Oregon, May 9, 1997 For value received, the undersigned promises to pay to the order of the City of Ashland, Oregon, the sum of $230.00, together with interest on unpaid principal computed from the date of this note at the rate of eight percent (8%) per annum. The entire balance, principal and accumulated interest, shall be due and payable when the undersigned's property at 242 West Hersey, Ashland, Oregon is sold, assigned or there occurs any transfer, whichever date is earlier. A sale, assignment or transfer can be voluntary or involuntary, and includes when any interest in the property is made, including, but not limited to, a fee simple interest, a co-tenancy interest, a survivorship interest, a life estate, a leasehold interest, any right to possession under a rental agreement, or an interest evidenced by a mortgage, trust deed or land sale contract in which possession of the home is transferred and the undersigned retain title. If this note is paid prior to May 9, 1998, then the interest specified above shall be waived by the holder of this note. If this note is placed in the hands of an attorney for collection, the undersigned promises and agrees to pay holder's reasonable attorney's fees and collection costs, even though no suit or action is filed; however, if a suit or an action is filed, the amount of such reasonable attorney's fees shall be fixed by the court, or courts in which the suit or action, including any appeal therein is tried, heard or decided.
