ASHLAND CITY COUNCIL ·
April 8, 1969
The regular meeting of the City Council was held in the
Council Chambers.of the City Hall on the above d'ate. The
meeting was called to order by Mayor McKeen at 7:30 P.M.
All Councilmen were present.
APPROVAL OF MINUTES:
It was moved by Haines, seconded by O'Harra that the minutes
of the April 8, 1969, meeting be approved and placed on file.
Motion carried unanimously.
S~ANDiNG COMMITTEE REPORTS:
a. Finance & Property Committee -.Chairman Cottle read
minutes of the Finance & Property Compri%tee meeting of
knrch 20, 1969. A copy of the minutes is attached. There
was some discussion regarding the proposed grant agreement
benween the Oregon Shakespearean Festival Association and
che City of Ashland. It was moved by Haines, seconded by
Cottle that the proposed agreement and other related material
be referred to the Ashland Development Commission for study.
On roll call, carried unanimously.

Streets & Traffic Committee - no report
c. Public Service Committee - no report
COMMUNICATIONS:
1. Letter from Charles Delsman, Jr., r~questing two service
parking spaces on Oregon Street adjacent to Southern Oregon
College. Following reading of letter by City Administrator
Boshears, it was moved by Willstatter, seconded by Cottle that
the matter be referred to the Streets & Traffic Committee for
study. On roll call, carried unanimously.
2. City Administrator Boshears indicated that several
letters have been received in response to Council resolution
regarding.Southern Oregon College expansion plans. No action
required by Council on matter.
3. City Administrator Boshears read letter from Donald Lewis,
Dean of Administration, Southern Oregon College, requesting

series of study sessions with the Council regarding college-
community common problems. (Matter to be continued following
8:00 P.M. public ~earing.)
SPECIAL AGENDA ITE~[S:
New & Miscellaneous Business:
1. 8:00 P.M. PUBLIC HEARING - durb, gutter and paving of
Beswick Way. City Attorney Skerry read ordinance ordering
in curb, gutter and paving. City Administrator Boshears
indicated that he had received a petition signed by two
property owners--Vernon Carlson and Jason Lee, protesting
any street work that would necessitate removal of trees, etc.
Mr. Carlson expressed concern regarding how far into his
property the curb, gutter and paving would come. Following
brief discussion, it was moved by Haines, seconded by Jones
that the hearing be continued until the next regular session
the City Council on April 22, 1969, at 8 P.M.
City Administrator Boshears indicated that the Council has
not yet made the determination of when the cut-off date for
the existing policy would be.' He pointed out that this
particular street would probably be'listed under the 1969
paving season. At this time, the Council instructed the
Street Department to stake curb lines.
Roll call on motion to continue public hearing, carried
unanimously.

3. Mr. Don Lewis pointed out that since there seemed to be
a conflict with the meeting date suggested (April 10), perhaps
the Council would want to reschedule another date for the first
of a series of. meetings. Haines indicated that he is in favor
of the suggestqd meetings; however, he feels that the meetings
would be more effectively conducted in the Council Chambers
where City information is readily available for disucssion
purposes. He further suggested that the City Council invite
Mr. Lewis and other appropriate parties to meet with the
Council in the Council Chambers. The date decided upon was
Monday, April 14, 1969, at 12 noon.
City Administrator Boshears indicated he had received a letter
from °R. W. Voris asking that the Council consider changing the
setback on Highway 66 to 35 feet from the center line of the
street. It was moved by Haines, seconded by Willstatter that
the letter be referred to the Planning Conunission for study
and recommendation. On roll call, carried unanimously.

At this time, Mr. Jack Edson, Architect, requested that the
Council consider the matter of eave overhang connected with
the construction of the section of the new theatre building
connecting the existing theatre. According to the Building
Code, the eave overhang should be constructe~ of 1-hour fire
resistive material. However, Mr. Edson explained that this
would conflict with the overall design of the building; and
since the overhang was not clos~ to any surrounding buildings,
no danger would be involved in the construction of overhangs
without the 1-hour. fire resistive material. Following some
discussion, it was moved by Jones, seconded by Roberts, that
Council reco~nend to the Appeals Board that Mr. Edson's request
regarding the construction of the eaves be accepted as being
within the meaning of reasonable interpretation of Section 1710
of the' Building Code. On roll call, carried 4-2, with Haines
dissenting and Willstatter abstaining.
At this time, Mr. Jim Conklin addressed the Council. He
explained that he planned to blacktop the parking lot next
to his building on Oak and C Streets. He was informed that
he must first obtain a conditional use permit in order to
convert the parking lot to a commercial parking lot. His
main objection was the "red tape" that one must go through
in order to "improve" the property.- He asked that the Council
give consideration to the problem and try to' come up with a
better solution. At this point, it was moved by Cottle
that the matter be considered by the Council. After brief
discussion, Cottle withdrew his motion. Cottle then moved
that the procedural portion of the Zoning Ordinance be
studied by the Finance & Property Committee, with the
understanding that the Con%mittee will contact the Planning
Commission for advice. Motion. seconded by Willstatter. On
roll call, carried unanimously.
Mr. Harold Hardesty addressed the Council regarding the matter
of obtaining a conditional use permit from the County for
20 acres of land which is adjacent to the City limits. City
Administrator Boshears explained that it has been the County's
policy to contact the City adjacent.to the County property
requesting the permit for any recommendations concerning the
i property. Mr, John Billings pointed out that the Ashland
· Planning Commission usually hand'led this kind of recommendation
to the County. After some discussion, it was referred to the
Planning Commission by the Mayor.

1. Award Df bids on 1 dump truck - matter deferred until

Boshears indicated that bids have not been received from the

State and recommended that the matter be deferred pending
receipt of bids from the State. Following brief discussion,
it was moved by Cottle, seconded by Haines that bids be
awarded to lowest bidder, among bids which have been received
at this time. On roll call, carried 5-1,. with Roberts
dissenting.
City Administrator Boshears indicated that the City had
received two bids on the station' wagon--Selby Chevrolet at
$3,097.38 and Lithia Motors at $3,427.25 (without trade-in).
Bid was awarded to apparent low bidder - Selby Chevrolet.

Former Councilman Duane Baker indicated that he objected to
awarding the bids before receiving the State bids. He pointed
out that in past 'purchases from the State, the City had exper-
ienced considerable savings.
Cottle expressed concern that the local bidders were not
being treated fairly if the Council postpones the awarding
of bids'until it has received the State bid.
It~was moved by Haines, seconded by Cottle that the apparent
low bid be accepted. On roll call,.carried 4-2 with Jones and
Roberts dissenting.
It was moved by Haines, seconded by Willstatter that awarding
of bids on dump truck be continued. On roll call, carried 5-1
with Jones dissenting.
At this time, Dr. Marvin Kochs briefly.reviewed the agenda
for the Fine Arts Festival scheduled for the weekend of
April 11-13.
2. City Administrator Boshears gave a brief sun~ary of
several bills currently before the State Legislature. He
indicated that~he will be attending a hearing in Salem on
Thursday, April 10, 1969, to discuss EB 1716 regarding tax
support for State institutions. Following some discussion,
it was moved by Cottle, seconded by Haines that it be recorded
that Council is in favor of HB 1716. On roll call, carried
unanimously.
Ordinances, Resolutions & Contracts:
1. City Attorney Skerry read Ordinance levying assessments for
Improvement District ~34. Following some discussion, it was
moved by Haines, seconded by Roberts that the rules be suspended
and ordinance passed to second reading by title only. On roll
call, carried 5-1 with Jones dissenting. Following second
reading by title only, it was moved by Roberts, 'seconded by
O'Harra that the Ordinance ~o. 1598 be adopted. On roll call,
carried 5-1 with Jones dissenting.

City Administrator Boshears pointed out that a proper cut-off
date should be established for the present paving policy.
It is the staff's recommendation that the new policy of
assessing on basis of actual cost per front foot (individual
petition) go into effect with the on-coming paving season for
1970. It is further recon%~ended that the City maintain the
present policy for the petition the City has now and accept
no future petitions for the 1969 paving season. It was
moved by Haines, seconded by Jones that the current paving
District ~34 be assessed on the basis of actual cost per
front foot to the property owner (per individual petition)
£or 1968. On roll call, 3-3. Motion defeated when Mayor
McKeen voted in opposition to the motion.
Following brief discussion, it was moved by Haines, seconded
by Roberts that the policy of actual cost per front foot to
property owners be assessed to all petitions presented to the
Council after April 8, 1969. On roll call, carried unanimously.
2. Ordinance amending Sign Code - City Attornay Skerry
indicated that after investigating the words non-combustible
and incombustible, he found them synonymous. Therefore,
an ordinance changing the wording in the Sign Ordinance is not
necessary.
Following brief discussion, City Attorney Skerry read ordinance
changing the wording in the Sign Ordinance from non-combustible
to incombustible, it was moved by Haines, seconded by Cottle
that the rules be suspended and ordinance passed to second reading
by ~itle only. On roll call, carried unanimously.
At this time, it was moved by Haines, seconded by Jones that
second reading of the ordinance be postponed until the next
Council meeting. On roll call, motion carried 4-2.
Following some discussion, it was moved by Roberts, seconded
by O'Harra that the motion was out of order and that it be
withdrawn.
It was then moved by Cottle, seconded by O'Harra that the
rules be suspended and ordinance passed to second reading by
title only. On roll call, carried 5-1 with Haines passing.
Following second reading by title only, it was moved by Cott!e,
seconded by O'Harra that Ordinance No. 1599 be adopted. On
roll call, carried unanimously.
City Attorney Skerry read ordinance repealing Section 26 of
Ordinance.No. 1558 defining offenses and enacting in lieu
thereof a new Section 26 entitle~ "Loitering or Prowling."
Following brief discussion, it was moved by Haines, seconded

Willstatter tha~ rules be suspended and ordinance passed to
second reading by title only. On roll call, carried
unanimously. Following second reading by tit~e only, it
was moved by Cottle, seconded by Haines that Ordinance No.
1600 be adopted. On roll call, carried unanimously.
City Attorney Skerry read ordinance indicating distribution
of general ordinances of City of Ashland. Following so,ne
discUssion, the Council agreed that each member should have
a copy of the codification. It was moved by Jones, seconded
by Cottle that the ordinance be rewritten to include
distribution to Mayor and Council. On roll call, carried
unanimously.
At this time, City Administrator Boshears pointed out that
at the first official meeting of the Citizens Budget Committee,
it was reco~ended~that the City Council call a special
election for April 30 for two special fi~e-year levies--one
for stree~ and one for the Police Department. Following brief
discussion, it was moved by Haines, seconded by Wi!lstatter
that staff be directed to prepare election materials for
the special election on April 30, 1969. On roll call, carried
5-1 with Jones dissenting.
There being no further business, the meeting was adjourned
subject to the call of the Mayor.
