OF TIlE .{~IC!PA.~ CODE REI~TIVE TO SPECIAL I,ICENSI NG PROCF. DURES TIlE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTiOI~] 1. Sectio~ 6.24.030 of the Ashland Municipal Code relativ,:z to Solicitors and Peddlers sh. all be amended by amending th'a first paragraph of subsection A to read as follows: "A. Applicants for a permit and license under this chapter must file with the Police DeparnmenE a sworn application on a form furnished by the Police Department, v~ich gives the following information:" SECTIO!,[ 2. Subsection B. of Section 6.24.030 of the Ashland Munici-pa--Y-Code shall be amended by changing the investigation fee to fifteen dollars ($15.00), and the words "City Recorder" shall be changed to "Chief of Police". SECTION 3. Section 6.24.040 of the Ashland Municipal Code shall-F~ amended to read as follows: "6.24.040 Investigation -- Issuance. Ao Upon receipt of such application, the Chief of Police shall cause such investigation of the applicant's business and moral character to be made as he deems necessary for the pro- tection of the public health, safety and welfare. B o If as a result of such investigation, the ~F~,~ s ~h~r~=r or business responsibil- ity is found to be unsatisfactory, the Chief of Police shall disapprove such application and shall state his reasons therefor and return the application to the applicant. In the event that the applicant disagrees with the findings of the Chief of Police, he or she may, within seven (7) days of notification by the Chief of Police, appeal the matter in writing to the City Council. The City Council shall hear the appeal at the next regular meeting of the Council and may either deny or grant the license as specified in subsection C hereof. -1- If as a result of such investigation, the character and business responsibility of the applicant are found to be satisfactory, the Chief of Police shall approve the application. Upon receipt of the prescribed license fee, the Chief of Police shall issue the permit and license, which shall contain the signature of the Chief of Police; the name, address and photograph of the licensee; the kind of goods or services to be sold; the amount of fee paid; the date of issuance and the length of time the license is valid; and the license number and description of any vehicle used in such solicitation or canvassing. The Police Depart- ment shall keep a record of all licenses issued." SECTION 4. Section 6.24.050 of the Ashland Municipal Code shall be amended to read as follows: "6.24.050 License -- Fee. The license fee charged shall be the same as a regular Business License fee as set forth in Section 6.04.080 of the Muni- cipal Code which shall be in lieu of a regular Business License." SECTION 5. Section 6.24.080 of the Ashland Municipal Code shall be amended to read as follows: "6.24.080 Records. The Chief of Police shall maintain a record of each license issued and of all complaints of violations thereof." SECTION 6. Section 6.08.030 of the Ashland Municipal Code shall be amended by adding a new subsection D. thereto, which shall read as follows: "D. The application shall be accompanied by a filing fee of fifteen dollars ($15.00) to cover the cost of investigation by the Police Department of the applicant's character and business responsibility." SECTION 7. Section 6.08.060 of the Ashland Municipal Code shall be amended to read as follows: "6.08.060 License Fees. Upon approval by the City Council, the applicant shall pay the regular business license fee as set forth in Section 6.04.080 of the Municipal Code which shall be in lieu of a regular business license." SECTION 8. Section 6.12.030 of the Ashland Municipal Code relating to Merchant Police shall be amended by adding a new subsection C thereto, which shall read as follows: -2- "C. The application shall be accompanied by a filing fee of fifteen dollars ($15.00) to cover the cost of investigation by the Police Depart- ment of the applicant's character and business responsibility".
