CITY OF ASHLAND BIKEPATH EASEMENT AGREEMENT Ashland School District No. 5 ("Grantor") conveys to the City of Ashland ("City") a non- exclusive easement in gross to use the property in Jackson County, Oregon, described as follows: See the attached Exhibit A. The terms of this easement are as follows: 1. Scope: This easement is for the purpose of providing bicycle and pedestrian access for the public across the property described above. 2. Duration: The duration of the easement created by this agreement shall be perpetual. 3. Prior Encumbrances: Grantors warrant that Grantors are the owners of the property and grant this easement subject to all prior easements or encumbrances of record. GRANTOR, AshlagcLS~hool District No. 5: PAGE i-BIKEWAY EASEMENT ~:~b~h.=~) EXHIBIT "A" A 13 foot wide easement across that tract of land being described as Parcel No. I of that Land Partition survey filed in Volume 2, Page 26, of "Minor Land Partitions" in the Records of Jackson County Oregon, situated in the East half of Section 10, Township 39 South, Rage 1 East of the Willamette Meridian, Jackson County, Oregon, being more fully described as follows: Commencing at the Southeast corner of Donation 'Land Claim Number 39 said township and range; thence South 89° 49' 44" East, 1,263.22 feet to a point on the East right-of-way line of Walker Avenue; thence North 0° 11' 19" West, 26.65 feet along said East right-of-way to the Northwest corner of above said Parcel No 1; thence North 89° 46' 41" East, 257.20 feet along the North boundary of above said Parcel No. 1 to a point where the North boundary intersect the former Southern Padfic Railroad right-of-way, for the true point of beginning; thence South 55° 13' 31" East, 561.85 feet along said Railroad right-of-way and Northeasterly boundary of said Parcel No. 1 to the Southeast corner thereof; thence leaving said Railroad right-of-way, South 89° 48' 41" West, 22.69 feet along the South boundary of said Parcel No. 1, thence leaving the South boundary of said Parcel No 1, North 55° 13' 31" West, 561.83 feet to the North boundary of said Parcel No. 1; thence, along said North boundary, North 89° 46' 41" East, 22.67 feet to the point of beginning.
