AGREEMENT
Gerald L. Newton and Phyllis Newton ("Grantors") convey to the City of Ashland
("City") a non-exclusive easement to use the property in Jackson County, Oregon,
described as follows:
See the attached Exhibit A.
The terms of this easement are as follows:
1. Scope: This easement is for the purpose of providing pedestrian access for the
public across Lot 4 of Hersey Heights Planned Unit Development.
2. Duration: The duration of the easement created by this agreement shall be
perpetual.
3. Consideration: City shall pay Grantors the sum of $1 and other good and valuable
consideration for this easement,
4. Prior Encumbrances: Grantors warrant that Grantors are the owners of the
property and grant this easement subject to all prior easements or encumbrances of
record,
5. Indemnification: To the extent permitted by law, City shall, within the limits of the
Oregon Tort Claims Act, indemnify Grantors against any liability for damage to life or
property arising from Grantors conveying this easement.

EXHIBIT 'A'
DESCRIPTION OF ACCESS EASEMENT
Beginning at the northwest comer of Lot 4 of Hersey Heights Planned Unit
Development to the City of Ashland, Jackson County, Oregon as recorded on September 27,
1979 and recorded in Volume 13 of plats at Page 98 of the records of Jackson County,
Oregon; thence along the north boundary of said Hersey Heights P.U.D., S 89° 57' 42" E,
24.00 feet; thence leaving said north boundary, S 36° 47' 52" W, 40.10 feet to the west
boundary of said Lot 4; thence along said west boundary N 00° 02' 18" E, 32.13 feet to the
point of beginning.
