THE JOB COUNCIL TRAINING PEOPLE FOR JOBS LETTER OF AGREEMENT between THE JOB COUNCIL and the CITY OF ASHLAND OVERVIEW This agreement outlines the responsibilities of The Job Council and the City of Ashland for the coordinated operation of an Oregon Youth Conservation Corps (OYCC) work project. The Agreement is in effect from October 1, 1994 or the date of signature (whichever is the earlier date), through August 31, 1995. The purpose of this project is to involve Phoenix High School students in a "hands on" educational work project, while the students continue their high school education through a set education plan. The students are expected to work approximately 18 hours per week during the project during the school year, and approximately 32 hours per week during the non-school, summer months. The students will be working primarily in the Hamilton Creek watershed above Ashland and on projects located in various Jackson County Park locations. The work performed by the students will be under supervision of a crew leader employed by The Job Council. The work will be conducted on lands owned by various public and private agencies. Work related technical assistance will be given to the crew supervisor by designated staff from the Ashland Ranger District Forest Service, Jackson County Parks, Soil Conservation Service, Southern Oregon Land Conservancy and others. In general, the project will focus on fire suppression, conservation and erosion control activities, upgrading and enhancing public facilities including campsites, trails, bike paths, horse corrals, bridge and ramp repair at Willow Lake and the Bear Creek Greenway, building and installing information kiosks on Bear Creek Greenway. CITY OF ASHLAND RESPONSIBILITIES Designate as the Agreement Manager for City of Ashland. The Agreement Manager will be expected to attend work planning meetings to coordinate the project. Provide a minimum of $18,490 of documented match in funding support for this project. Match money is defined as materials and supplies donated to the project as well as the of wage and fringe of staff directly involved with this project. Any changes to the source or amount of match must be made in agreement with The Job Council. Letter of Agreement between The Job Council and the City of Ashland Page 2 3. Provide technical assistance and/or instruction for project activities when appropriate. Maintain documentation to support each match source. This documentation will include the following: Pay records and cancelled checks for all staff positions. Receipts that support the value of materials donated to the project. For each staff position, a calendar of time directly attributable to this project which will include the date of the activity, the type of activity and the amount of time by activity. Complete one six-month summary (October 1, 1994 through February 28, 1995) of financial match using the Match Reporting Document provided by The Job Council (Attachment 1). Completed Match Reports should be submitted to Barry Whetsine, Agreement Manager on behalf of this project for The Job Council no later than March 10, 1995. Complete one end-of-project summary covering Mamh 1, 1995 through August 31, 1995 documenting financial match. This summary must be submitted to The Job Council no later than September 13, 1995. As required by the Oregon Youth Conservation Corps, City of Ashland makes that following program assurances. Project participants will not be used to complete jobs or job duties that would displace existing employees or duplicate existing private or government programs. Projects participants will be devoted to activities that enhance the community and are not based on maintenance activities. City of Ashland shall indemnify and hold harmless The Job Council, State of Oregon, Oregon Youth Conservation Corps, Oregon Commission on Children & Families, its officers, agents, employees, and members from all claims, suits, and actions resulting from or arising out of the activities of City of Ashland or its agents, or employees in connection with this Agreement. THE JOB COUNCIL RESPONSIBILITIES The Job Council will designate Barry Whetstine as The Job Council Agreement Manager. In general, the Agreement Manager is responsible for coordinating communication between The Job Council and the City of Ashland, problem solving, monitoring agreement compliance and coordinating preparation of six-month and end- of-project reports. The Agreement Manager is also responsible for reviewing summary reports of match and submitting it to The Job Council Fiscal Manager. Determine participant Job Training Partnership Act (JTPA) eligibility, verify eligibility factors and complete all necessary eligibility paperwork. Letter of Agreement between The Job Council and the City of Ashland Page 3 3. Select and compensate six Phoenix High School students to be participants. Hire and compensate a qualified crew supervisor to supervise project participants while work is performed on the Project. 5. Coordinate and be responsible for all student transportation to and from Project sites. 6. Provide funding for all necessary work clothing and safety gear. Provide studems with wage and fringe for work performed on Project sites. The Job Council crew supervisor will be responsible for reporting student work time. The Job Council Agreement Manager will process time sheets tl~rough The Job Council fiscal system. 8. Provide workers' compensation insurance as required by federal and state law. 9. Coordinate all specialized training for the project. Each of the Parties will comply with all applicable requirements of federal, state and local laws and ordinances applicable to work to be done pursuant to this agreement, including but not limited to applicable child labor laws and requirements of federal and state civil rights and rehabilitation statutes, rules and regulations.
