CITY OF ASHLAND
EASEMENT AGREEMENT
Jerry Toney & Debra Lynn Toney ("Grantors") convey to the City of Ashland ("City") a non-exclusive
easement to use the property in Jackson County, Oregon described as follows:
See attached Exhibit "A"
The terms of this easement are as follows:
1. Scope:
City shall have the right to use the property to construct and maintain public utilities.
2. Duration: The duration of the easement created by this agreement shall be perpetual.
3. Consideration:
City shall pay Grantors the sum of $1.00 as consideration for this easement.
Prior Encumbrances:
Grantors warrant that Grantors are the owners of the property and grant
this easement subject to ail prior easements or encumbrances of record.

Commencing at a 5/8 inch diameter steel pin marking the
South-Southwest corner of Parcel 1 of Partition Plat No.
P-16-1992 of the Records of Partition Plats for Jackson
County, Oregon and filed as survey number 12863 in the office
of the Jackson County Surveyor and being located in the
Northeast quarter of Section 5, Township 39 South, Range
East of the Willamette Meridian in Jackson County, Oregon;
thence South 89o 45' 20" East, along the South line of said
Parcel, 9.91 feet to the TRUE POINT OF BEGINNING; thence
continue South 89° 45' 20" East along said South line 50.33
feet; thence North 3° 52' 36" West 12.03 feet; thence North
89° 45' 20" West, parallel with said South line of Parcel 1,
49.47 feet; thence South 0° 14' 40" West 12.00 feet to the
true point of beginning.
