UTILITIES EASEMENT

Eugene P. Brummett and MarilynJ. Brummett, husband and wife,
hereinafter referred to as 'Grantors', conveys to the City of
Ashland, a municipal corporation of the State of Oregon,
hereinafter referred to as ~Grantee', an easement to use a portion
of Grantors' property described on the attached Exhibit 'A',
incorporated herein and by this reference made a part hereof.
The terms of this easement are as follows:
1. The Grantee, its agents, independent contractors and invites
shall have the right of ingress and egress and use the easement to
construct, reconstruct, install, use, operate, inspect, repafr,
maintain and remove utility lines, including but not limited to
lines for electricity, sewer, water, gas and telecommunications,
and all other necessary related, facilities over, across and
through that real property described on attached Exhibit 'A', as
reference hereinabove.
2. The consideration for this easement is $1.00.
3. This easement is granted subject to all prior easements or
encumbrances of record.

EXHIBIT 'A'
EASEMENT DESCRIPTION
A Public Utility Easement over, across and through a strip of land
variable in width and being more fully described as follows:
Beginning at a found 5/8 inch iron rod situated at the
Southeast corner of Lot 2 of SCENIC ESTATES, a Planned Unit
Development to the City of Ashland, as now recorded;
THENCE North 00 degrees 26 minutes 45 seconds West along the
Easterly boundary line of Lot 1 of said Estates for a distance of
14.00 feet;
THENCE leaving said Easterly boundary line, South 89 degrees
55 minutes 43 seconds East for a distance of 10.00 feet;
THENCE South 00 degrees 26 minutes 45 seconds East for a
distance of 8.00 feet to a point situated 6.0 feet Northerly of,
when measured normal therefrom, the boundary line common to Lots 6
and 7 of Block 36 of the Coolidge's Tract;
THENCE South 89 degrees 55 minutes 43 seconds East, parallel
with and 6.0 feet Northerly of, when measured normal therefrom,
the Southerly boundary line of Lot 3 of Block 36 of the Coolidge's
Tract, as now recorded, for a distance of 80.18 feet;
THENCE North 82 degrees 56 minutes 23 seconds East for a
distance of 20.13 feet to a point in the Westerly right of way
line of Rock Street;
THENCE South 00 degrees 25 minutes 35 seconds East along said
Westerly right of way line for a distance of 8.50 feet to the
corner common to Lots 2 and 3 of Block 36 of said Coolidge's
Tract;
THENCE leaving said Westerly right of way line North 89
degrees 55 minutes 43 seconds West along the boundary line common
to said Lots 2 and 3 for a distance of 100.09 feet to the corner
common to Lots 2, 3, 6 and 7 of Block 36 of said Coolidge's Tract;
THENCE North 89 degrees 55 minutes 44 seconds West along the
boundary line common to Lots 6 and 7 of Block 36 for a distance of
10.09 feet to the Southeast corner of Lot 2 of SCENIC ESTATES, a
Planned Unit Development to the City of Ashland and there
terminating.
Together with and subject to covenants~ easements, and
restrictions of record and those apparent on the land.

Enclosed, for your records, is a copy of the recorded easement you signed in March.
I would like to thank you on behalf of the City of Ashland for your cooperation in granting
this easement concerning the six inch sanitary sewer re-alignment between Rock Street and
Scenic Street. Also, enclosed is a check for $1.00 as specified by the easement agreement.
