HomeMy WebLinkAbout1993-105 Easement - Harper 94-0&703 CITY OF ASHLAND PUMP STATION EASEMENT /¢oo Richard E. Harper and Roberta L. Harper, hereinafter referred to as "Grantors", conveys to the City of Ashland, a municipal corporation of the State of Oregon, hereinafter referred to as "Grantee", an easement to use a portion of Grantors' property described on the attached Exhibit "A", incorporated herein and by this reference made a part hereof. The terms of this easement are as follows: Grantee, its agents, independent contractors and invitees shall have the right to construct, reconstruct, maintain, use, operate, and repair pumping facilities including pipelines of the municipal sewer system of grantee together with the right to make such excavation therein as grantee may require and deem convenient for the installation, repair or maintenance of such facilities; including such reasonable right of ingress and egress to and from such easement as may be necessary to :arry out iB purposes 2. It is the intent of the easement to define the true and actual location of the pump station as constructed. If a conflict should arise between the described location and the actual location, the latter shall prevail and the easement shall be defined by the pump station as physically situated. ALSO a strip of land, fifteen feet in width and lying seven and one half feet on each side of the following described line: Commencing at the Northeast Comer of Donation Land Claim No. 53 in said Township 39 South, Range 1 East, Willamette Meridian, Jackson County, Oregon; thence South 29°36'31'' West, 2,350.96 feet to the Point of Beginning of said easement being on the southerly right of way line of East Nevada Street; thence South, 6.50 feet to a point which is seven and one half feet north of the center of Manhole A1 as shown on the construction plans for the North Mountain Avenue Sanitary Sewer L.I.D., Ashland, Oregon, being the Point of Termination of said easement. ALSO a strip of land fifteen feet in width and lying seven and one half feet on each side of the following described line: Commencing at the Northeast Comer of Donation Land Claim No. 53 in said Township 39 South, Range I East, Willamette Meridian, Jackson County, Oregon; zl'..er, ce South 30o01'43.'
