The undersigned, for themselves, their heirs, successors and assigns, hereby consent to permit
obstruction of their solar access rights as guaranteed by Chapter 18.70 of the Ashland Municipal Code
on that portion of Tax Lot 39 1E , further described by legal description in
attached Exhibit "A". The undersigned certify and agree to the following:
This Agreement shall be binding upon their heirs, successors and assigns and shall run with the land.
2. He/She/They are listed below as property owner(s).
That this Waiver applies only to the specific building(s) noted in Exhibit "A"; and to the shadow cast by that
building as noted in Exhibit "A".
That the solar access guaranteed by Chapter 1&70 of the Ashland Municipal Code is waived only for that
buildable space shown on Exhibit "A" and the City of Ashland is hereby indemnified and shall be held
harmless for any damages resulting to it form this Waiver.

The consideration for this Agreement is ONE DOLLAR ($1.00) and other good and valuable consideration,
the receipt of which is hereby acknowledged by the property owner(s).
