Cov - Zieminski RESTRICTIVE COVENANT The undersigned for themselves, their heirs, executors, administrators and assigns, covenant with the City of Ashland, Oregon, with respect to the 'hereinafter described land, that they will not partition, subdivide nor apply for a partition or subdivision, nor will they lease, rent, give an option to buy or allow the use of less than the whole of the land as described in attached Exhibit "A". Upon annexation to the City of Ashland, this Restrictive Covenant shall automatically terminate. The undersigned warrant and represent to the City of Ashland, that they are the owners or contract purchasers of the land as described in attached Exhibit "A". The covenant contained herein shall run with the land herein described and shall also inure to the benefit of the City of Ashland, Oregon. The land which is restricted by this covenant is located in the County of Jackson, State of Oregon, and more particularly described on Exhibit "A" which is attached hereto and incorporated herein. The consideration for this covenant is the furnishing of sewer services to the land while it is outside of the City of Ashland and by the City of Ashland, Oregon. Before me. expires: ~;'~' ~)~ Notary 'Pu C ~Or Oregon My Commission 92-21553 EXHIBIT A Beginning at the northeast corner of the Southwest Quarter of the Northeast Quarter of Section 14 in Township 39 South of Range 1 East of the Willamette Meridian in Jackson County, Oregon; thence West 438.0 feet; thence South 0 degrees 17 minutes West 130.0 feet; thence East 438.0 feet to the east line of the Southwest Quarter of the Northeast Quarter of said section; thence North 0 degrees 17 minutes East, along said line, 130.0 feet to the point of beginning. EXCEPTING THEREFROM that portion conveyed to the STATE OF OREGON (by and through its State Highway Commission), by Deed recorded in Volume 509 page 383 of the Deed Records of Jackson County, Oregon.
