for the consideration hereinafter stated, does hereby grant, bargain, sell and convey unto
City of Ashland, Oregon . ,
hereinafter called grantee, and unto grantee's heirs, successors and assigns all o£ that certain real property with the
tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, situated in the County
of Jackson , State of Oregon, described as follows, to-wit:
See Exhibit "A" attached hereto.
Subject to the following:
No improvements, structures, signs (other than signs
appropriate for park management not to exceed two
square feet) or other man-made objects may be placed
upon the property.

No living trees may be cut or removed from the property
~ except where such trees endanger public safety, are
diseased, or must be removed for fire safety reasons.
The foregoing restrictions shall be enforceable by Grantors,
their heirs, assigns and successors in interest for the beneift
of Grantors' adjoining real property and by the City of Ashland
for the benefit of the people of the City of Ashland, Oregon.
In addition to all other remedies provided by law, if any of the
foregoing restrictions is violated by Grantee or grantee's employees,
agents or assigns, then the real property conveyed hereby shall
revert to Grantors and their heirs.

Commencing at a found 2" iron pipe situated at the accepted
east-sixteenth section corner common to Sections 5 and 8 in Township 39
South, Range I East of the Willamette Meridian in Jackson County,
Oregon, thence North 89e42t58" West, along the section line common to
said Sections 5 and 8, a distance of 233.38 feet to a 3/4" iron pipe
situated in the Southwesterly right of way line of Grandvtew Drive, as
set forth on that Road Plat drawn by F. Walker, Ashland City Engineer,
and approved by the Common Council of the City of Ashland, for the true
point of beginning; thence North 49°35'22" West (Plat Record North
49e56' West), along the Southwesterly right of way line of said
Grandview Drive, for a distance of 279.19 feet to a 3/4" x 24" iron
pipe; thence continuing, along said Southwesterly right of way llne,
North 27°05'22" West (Plat Record North 27'26t West), for a distance of
162.44 feet to a 3/4" x 24" iron pipe situated in the Southerly right
of way line of an alley situated in the WOOLENS ADDITION to the City of
Ashland, Jackson County, Oregon, according to the Official Plat thereof,
now of recordI thence, leaving said Southwesterly right of way line,
North 89°48'14" West, along the Southerly right of way line of said
alley (Plat Record West), for a distance of 59.70 feet to a 3/4" x 24"
iron pipe situated at the intersection of said Southerly right of way
line with the Northeasterly right of way line of Ditch Road, as set
forth in Volume 109, Page 153-4 of the Deed Records of Jackson County,
OregonI thence, leaving the Southerly right of way line of said alley,
South 21°05'00" East (deed record North 21°05, West), along the
Northeasterly right of way llne of Ditch Road, for a distance of 184.77
feet to a 3/4" x 24" iron pipe; thence, continuing along said right of
way line, South 35°27'00" East (deed record North 35"27' West), for a
distance of 160.36 feet to a 3/4" x 24" iron pipe; thence, along said
road right of way line, South 41°11'00" East (deed record North 41°11'
West) for a distance of 29.16 feet to a found 5/8" iron rod situated in
the section line common to said Sections 5 and S; thence, leaving said
road right of way line, South 89°42'58'' East, along said common section
line, for a distance of 158.27 feet to a found 5/8" iron rod; thence
continuing South 89°42'58" East, along said section line, for a
distance of 9.3i feet to the point of beginning.
