ORDER AND NOTICE OF
PUBLIC HEARING
Oregon Revised Statute No. 760.050, entitled "Establishing Speed
Limits for Trains Within City Limits," provides that:
(1) The power to fix and regulate the speed of railway
trains within the limits of cities of less than 100,000 pop-
ulation is vested exclusively in the state.
(2) Upon petition of any incorporated city or of any
railroad or upon his own motion, the Commissioner shall, after
due investigation and hearing, enter an order fixing and regu-
lating the speed of railway trains within the corporate limits
of cities of less than 100,000 population. Any such order may
relate to and include more than one such city or particular
portions of any one or more cities.
Pursuant thereto, it is therefore,
ORDERED that an investigation bemade and that a hearing be held
at the time and place indicated below with respect to the speed of trains
operating on the Coos Bay, Woodburn-Springfield, West Side, Mill City
and Marcola Branches of Southern Pacific Company within the corporate
limits of Eugene, Springfield, Coburg, Lebanon, MOnroe and Gates; and,
'over certain main line spur crossings in the cities of Ashland, Medford,
Glendale, Roseburg, Drain, Cottage Grove, Junctiou City and Klamath Falls,
at which time all parties having an interest therein may present such evi-
dence and testimony as may be relevant thereto; and
NOTICE hereby is given that such hearing will be held as follows:
In the County Courthouse, Eugene, Lane County, Oregon
Wednesday, July 8, 1959, at 10:30 a.m.

Gentlemen:
The Public Utility Commissioner's Order No. 34178. fixing the
maximUm train speeds through the cities on the main line of Southern
Pacific Company. was issued by the Commissioner on November 17, 1955,
pursuant to the authority therein granted by ORS 760.050. A copy of
the order was mailed to you on that date.
At the hearing held prior to the issuance of Order No,
34178. no consideration was given to the spur track crossings within
the several cities over which switching movements only are conducted.
It is now considered necessary and desirable to fix a maximum
speed for trains operating over these crossings, and the matters rele-
vant thereto will be considered at the hearing to be held in the Lane
County Courthouse, Eugene, Oregon, July 8, 1959. as indicated on the
accompanying Order & Notice of Hearing.
The attached "Data Sheets," bearing the crossing numbers of
the spur track crossings in your city, and showing thereon certain in-
formation pertinent to the crossings involved, will be a part of the
Public Utility Commissioner's exhibit that will be submitted at the
hearing. The entry "15" which appears thereon as

denotes the maximum speed presently allowed by Southern Pacific Company
in accordance with the special instructions governing its train operations.
Subsequent to the forthcoming hearing, an order will be is-
sued fixing the maximum train speeds over these spur crossings at a
rate commensurate with the hazards involved and the practical opera-
tion of trains. In no event will it be greater than 15 miles per hour,
and, if conditions so warrant, it may be fixed at a lower rate.
Your recommendation, voiced at the hearing, will be made a
matter of record and considered in making the determination as to the
maximum speeds.
