actions as required by the Cl'q/ of Ashland, ar',d agree to bear the propo~onate payment of assocJated costs. This
Agreement Is to be binding upon myself/ourselves, my/our heir(s), executors, and assigns, and It L~ my/our express Intention
that thee Agreement ehaJl run wIth the land, so that fulfillment of the Items listed below shall be binding upon future owners
of the property. This consent Is in consideration of APPROVAL OF A SITE REVIEW FOR A NEW SHOPPING CENTER
AND A MINOR LAND PARTITION AND BOUNDARY UNE ADJUSTMENT.
IMPROVEMENT, DEDiCATiON OR OTHER ACTION:
1) AGREE TO PARTICIPATE IN THE LOCAL IMPROVEMENT DISTRICT FOR THE FUTURE IMPROVEMENT OF
TOLMAN CREEK ROAD, INCLUDING CURB, GUTTER, PAVING, STORM DRAIN, SIDEWALK AND
UNDERGROUNDING OF UTILITIES; AND AGREE NOT TO REMONSTRATE TO THE FORMATION OF SUCH
LOCAL IMPROVEMENT DISTRICT; AND AGREE TO PAY ASSIGNED SHARE OF SUCH DESIGNATION
IMPROVEMENT COSTS.
2) AGREE TO PARTIC!PATE !N THE LOCAL IMPROVEMENT DISTRICT FOR THE FUTURE INSTALLATION OF
TRAFFIC SIGNALIZATION IMPROVEMENTS FCR THE INTERSECTION OF TOLMAN CREEK ROAD AND
ASHLAND STREET; AND AGREE NOT TO REMONSTRATE TO THE FORMATION OF SUCH LOCAL
IMPROVEMENT DISTRICT; AND AGREE TO PAY ASSIGNED SHARE OF SUCH DESIGNATED IMPROVEMENT
COSTS.
