Charles C. Setchell, Grantor, conveys and warrants to CITY
OF ASHLAND, a municipal corporation, Grantee, the following real
property described on the attached Exhibit A, free of
encumbrances except as specifically set forth herein.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCRIBED
IN THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS
AND REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS
INSTRUMENT THE PERSON ACQUIRING FEE TITLE TO THE PROPERTY
SHOULD CHECK WITH THE APPROPRIATE CITY OR COUNTY PLANNING
DEPARTMENT TO VERIFY ITS USES.

EXHIBIT "A"
RIGHT OF WAY DESCRIPTION
Commencing at the Southeast corner of Donation Land Claim No.
45, Township 59 South, Range 1 East of the Willamette Base and
Meridian, Jackson County, Oregon;
THENCE South 00 degrees 12 minutes 45 seconds West (deed
record South~ 1217.7 feet) for a distance of 1217.70 feet;
THENCE North 89 degrees 47 minutes 17 seconds West (deed
record Volume 18, Page 488= West, 196.68 feet) for a distance of
196.68 feet to the Northeast corner of that tract of land conveyed
by W.N. Atkinson and wife, et al, to W.F. Loomis and as set forth
in Volume 18, Page 488 of the Deed Records of Jackson County,
Oregon;
THENCE continuing North 89 degrees 47 minutes 17 seconds West
(deed record West) along the Northerly boundary line of said
Loomis tract and being parallel with the South line of Donation
Land Claim No. 45 for a distance of 755.56 feet (deed record
755.56 feet) to the Northeast corner of that tract of land as
conveyed by Cynthia Ann Eddy to Charles C. Setchell and Dorotyh
Fay Setchell, husband and wife, as set forth in Document No. 74-
08695 of the Official Records of Jackson County, Oregon, for the
TRUE POINT OF BEGINNING;
THENCE continuing North 89 degrees 47 minutes 17 seconds West
(deed record West) along said Loomis North boundary line and
parallel with the South line of Donation Land Claim No. 45 for a
distance of 15.85 feet to a point which is 20.00 feet Westerly of,
when measured normal therefrom, the Southerly prolongation of the
centerline of Garden Way as set forth in the Garden Homes Tracts,
Clarks Addition to Ashland, as now recorded;
THENCE South 00 degrees 06 minutes 45 seconds West (plat
record South) and parallel with the centerline of Garden Way,
prolonged Southerly, for a distance of 20.00 feet;
THENCE South 89 degrees 47 m£nutes 17 seconds East and
parallel with the South line of Donation Land Claim No. 45 for a
distance of 15.80 feet to a point in the Westerly boundary line of
that tract of land conveyed from Robert 0. McGee to Oarus D. McGee
and set forth in Document No. 85-05951 of the Official Records of
Jackson County, Oregon;
THENCE North 00 degrees 12 minutes 45 seconds East (deed
record North) along said Westerly boundary line, for a distance of
