Charles C. Setchell , "Grantor", in consideration of the sum of ONE DOLLAR
($1.00) paid by CITY OF ASHLAND, OREGON, "Grantee", grants to Grantee a perpetual
non-exclusive easement to construct, reconstruct, install, use, operate, inspect, repair,
maintain and remove utility lines, including but not limited to lines for electricity, sewer,
water, gas and telecommunications, and all necessary related facilities over and under
real property described on attached Exhibit A together with the right of ingress and
egress over adjacent lands owned by Grantee for all necessary purposes in connection
with the rights above granted. Grantee may assign this easement to the person,
corporation, utility company or governmental entity operating the utility.
Grantor may use the surface of the easement for any purposes which will not interfere
with the purpose for the easement. Provided, that no permanent structure shall be
constructed by Grantor within the easement area.

PUBLIC UTILITY EASEMENT
Commencing at the Southeast corner of Donation Land Claim No.
45, Township 59 South, Range i East of the Willamette Base and
Meridian, Jackson County~ Oregon;
THENCE South 00 degrees 12 minutes 45 seconds West (deed
record South, 1217.7 feet) for a distance of 1217.70 feet;
THENCE North 89 degrees 47 minutes 17 secends West (deed
record Volume 18, Page 488= West, 196.68 feet) for a distance of
196.68 feet to the Northeast corner of that tract of land conveyed
by W.N. Atkinson and wife, et al, to W.F. Loomis and as set forth
in Volume 18, Page 488 of the Deed Records of Jackson County,
Oregon;
THENCE continuing North 89 degrees 47 minutes 17 seconds West
(deed record West) along the Northerly boundary line of said
Loomis tract and being parallel with the South line of Donation
Land Claim No. 45 for a distance of 753.56 feet (deed record
755.56 feet) to the Northeast corner of that tract of land as
conveyed by Cynthia Ann Eddy to Charles C. Setchell and Dorotyh
Fay Setchell, husband and wife, as set forth in Document Ne. 74-
08695 of the Official Records of Jackson County, Oregon;
THENCE continuing North 89 degrees 47 minutes t7 seconds West
(deed record West) along the Northerly boundary line of said
Loomis tract and being parallel with the South line ef Donation
Land Claim Ne. 45 for a distance of 15.85 feet to a point in the
proposed Southerly prolongation of the Westerly right of way line
of Garden Way for the TRUE POINT OF BEGINNING;
THENCE continuing North 89 degrees 47 minutes 17 seconds West
(deed record West) along the Northerly. boundary line of said
Loomis tract and being parallel' with the South line of Donation
Land Claim No. 45 for a distance of 152.84 feet to the Northwest
corner of that tract ef land as set forth in Document No~ 74-08693
of the Official Records of Jackson County, Oregon;
THENCE South 00 degrees 12 minutes 45 seconds West (deed
record South) along the Westerly boundary line of that tract of
land as recited in said document for a distance of 15.00 feet;
THENCE leaving said Westerly boundary line South 89 degrees
47 minutes 17 seconds East and parallel to the South line of
Donation Land Claim No. 45 for a distance of 152.87 feet to a
point in the proposed Southerly prolongation of the Westerly right
of way line of Garden Way, said right of way line being 20.00 feet
Westerly of, when measured normal therefrom, the Southerly
prolongation of the centerline of Garden Way as set forth in the
Garden Homes Tra~t, Clarks Addition to Ashland, as now recorded;
THENCE North 00 degrees 06 minutes 43 seconds East (plat
record North) along said Southerly prolongation, for a distance of
15.00 feet to the point of beginning.
