Jere H. Hudson and Roberta L. Hudson, husband and wife,
Grantors, convey and warrant to CITY OF ASHLAND, Grantee, the
real property in Jackson County, Oregon described on the attached
Exhibit A, free of encumbrances except as specifically set forth
herein.
RESERVING THEREFROM, a Sanitary Sewer Easement over, across and
through a strip of land 10.0 feet in width lying 5.0 feet on each
side of, when measured normal therefrom, the existing 4 inch
Sanitary Sewer pipeline leading from the Grantors place of
residence on Strawberry Lane, in the City of Ashland to Nutley
Street right of way, as the pipeline is now situated.
The City of Ashland takes title to the property as described on
Exhibit A with the understanding that the property shall be used
EXCLUSIVELY for OPEN SPACE DEVELOPMENT, provided, however, that
City may construct, reconstruct, install, use, operate, inspect,
repair, maintain and remove underground utility lines, including
but not limited to lines for electricity, sewer, water, gas and
telecommunications, and all necessary related facilities.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCRIBED
IN THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS
AND REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS
INSTRUMENT THE PERSON ACQUIRING FEE TITLE TO THE PROPERTY
SHOULD CHECK WITH THE APPROPRIATE CITY OR COUNTY PLANNING
DEPARTMENT TO VERIFY ITS USES.

LAND DESCRIPTION
Commencing at a found 2 inch black iron pipe situated at
the Accepted East one-sixteenth section corner common to
Sections 5 and 8, Township 39 South~ Range I East of the
Willamette Base and Meridian, Jackson County~ Oregon;
THENCE South 02 degrees 08 minutes 59 seconds along the
North-South centerline of the Northeast quarter of said Section
8 for a distance of 1982.82 feet to a 5/8 inch iron red
situated at the Center-South-Northeast one-sixtyfourth corner
of said Section 8 for the TRUE POINT OF BEGINNING;
THENCE leaving said North-South centerline of the
Northeast quarter of said Section 8, South 89 degrees 58
minutes 10 seconds West along the boundary line as set forth on
that Minor Land Partition filed for record the 25th day of
October, 1978 and recorded in Volume 2, Page 55 of "Minor Land
Partitions" in Jackson County, Oregon and Filed Survey No.
1~526 in the office of the Jackson County Surveyor for a
distance of 95.78 feet to an iron rod situated in the Easterly
right of way line of Ditch Road as set forth on both of the
hereinabove referred to surveys;
THENCE along the said Easterly right of way line of Ditch
Road along a curve to the left, having a radius of 192.~ feet
and an arc length of 49.8~ feet, being subtended by a chord of
North 04 degrees 09 minutes 26 seconds East for a distance of
49.66 feet to an iron rod;
THENCE continuing along said Easterly right of way line
North 03 degrees 16 minutes 25 seconds West for a distance of
36.08 feet to an iron rod situated at the intersection with the
Westerly extension of the Northerly right of way line of Nutley
Street, as Nutley Street was surveyed and set forth on Filed
Survey No. 10456 in the office of the Jackson County Surveyor;
THENCE leaving said Easterly right of way line South 89
degrees 54 minutes 40 seconds East along the Westerly extension
of the Northerly right of way line of Nutley Street for a
distance of 24.47 feet to an iron red Witness Corner;
THENCE continuing along said Westerly right of way line
extension South 89 degrees 54 minutes 40 seconds East for a
distance of 70.975 feet to an iron rod situated in the North-
South centerline of the Northeast quarter of Section 8, said
Township and Range and the Westerly terminus of said Nutley
Street;
THENCE South 02 degrees 08 minutes 59 seconds West along
said North-South centerline of said Northeast quarter of
Section 8 and the Westerly end of Nutley Street for a
distance of 40.025 feet to an iron rod situated at the Westerly
terminus of the Southerly right of way line of Nutley Street as
shown on Filed Survey No. 1~456 in the office of the Jackson
County Surveyor;
THENCE continuing South 02 degrees 08 minutes 59 seconds
West along said North-South centerline of the Northeast quarter

of Section 8 for a distance of 45.59 feet to the point of
beginning.
Together with and subject to covenants, easements,
restrictions of record and those apparent on the land.
