Hudson and Roberta Grantors, convey and warrant to real property in Jackson County, Exhibit A, free of encumbrances herein. L. Hudson, husband and wife, CITY OF ASHLJ~ND, Grantee, the Oregon described on the attached except as specifically set forth RESERVING THEREFROM, a Sanitary Sewer Easement over, across and through a strip of land 10.0 feet in width lying 5.0 feet on each side of, when measured normal therefrom, the existing 4 inch Sanitary Sewer pipeline leading from the Grantors place of residence on Strawberry Lane, in the city of Ashland to Nutley Street right of way, as the pipeline is now situated. Grantee takes title to the property as described on Exhibit A with the understanding that the property shall be used EXCLUSIVELY for OPEN SPACE DEVELOPMENT, provided, however, that City may construct, reconstruct, install, use, operate, inspect, repair, maintain and remove underground utility lines, including but not limited to lines for electricity, sewer, water, gas and telecommunications, and all necessary related facilities including a pump station which may be partially aboveground. THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCRIBED IN THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS AND REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT THE PERSON ACQUIRING FEE TITLE TO THE PROPERTY SHOULD CHECK WITH THE APPROPRIATE CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY ITS USES. NIL. Hudson and Roberta L. /~Nudson. ~ Notary ~ublic for Oregon ~o'~,~v ~ ~ o~:c~o~ My commission expires: i-WARRANTY DEED (p:agree/hudson) LAND E~IBIT'A' DESCRI Commencing at the ACCk~PTED Northwest corner of Government Lot 1, Section 8 in Township 39 South, Range 1 East of the Willamette Base and Meridian, Jackson County, Oregon; THENCE South 02 degrees 08 minutes 59 seconds West along the North-South centerline of the Northeast quarter of said section for a distance of 1982.62 feet to the Center-South Northeast one sixty-fourth corner being common to the Southeast corner of the North half of the Southwest quarter of the Northeast quarter of said Section 8; THENCE leaving said North-South centerline of the Northeast quarter of said section, South 89 degrees 58 minutes 10 seconds West along the Southerly boundary line of said North half of the Southwest quarter of the Northeast quarter of Section 8, for a distance of 136.86 feet to a found 5/8 inch iron rod situated in the Westerly right of way line of Ditch Road as set forth on that Minor Land Partition plat filed for Jere Hudson and recorded the 25th day of October, 1978 and filed in Volume 2 at Page 55 of "MINOR LAND PARTITIONS" in Jackson County, Oregon and being the TRUE POINT OF BEGINNING; THENCE continuing along said Southerly boundary line, South 89 degrees 58 minutes 10 seconds West for a distance of 238.445 feet to a 3/4 x 30 inch galvanized iron pipe situated in the Easterly right of way line of Strawberry Lane as established on that Minor Land Partition as referred to hereinabove; THENCE North 10 degrees 56 minutes 00 seconds West along said Easterly right of way line for a distance of 79.885 feet to a found 5/8 inch iron rod situated at the beginning of a curve to the left; THS~CE along a curve to the left having a radius of 97.00 feet and an arc length of 9.693 ieet, being subtended by a chord of North 13 degrees 37 minutes 08 seconds West for a distance of 9.069 feet to a 3/4 x 30 inch galvanized iron pipe; THENCE leaving said Easterly right of way line, South 89 degrees 54 minutes 40 seconds East for a distance of 258.22 feet to a 3/4 x 30 inch galvanized iron pipe situated in the Westerly right of way line of Ditch Road as set forth on that Minor Land Partition plat as referred to hereinabove; THENCE South 03 degrees 16 minutes 25 seconds East along said Westerly right of way line of Ditch Road for a distance of 39.65 feet to a found 5/8 inch iron rod situated at the beginning of a curve to the right; T}~NCE along a curve to the right having a radius of 150.00 feet and an arc length of 43.415 feet, being subtended by a chord of South 05 degrees 01 minutes ~5 seconds West for a distance of 43.264 feet to a found 5/8 inch iron rod; ~q~NCE continuing along said Easterly right of way line, South 13 degrees 18 minutes 35 seconds West for a distance of 4.17 feet to the point of beginning.
