EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That
VAT!KY OF THE P4DG%~ BANK, an Oregon Corporation
, hereinafter called grantor,
for the consideration hereinafter stated, does hereby grant, bargain,
sell and convey unto CITY OF ASHLAND, A Municipal CorporatiQ~
of the State of Oregon
, hereinafter called grantee,
and unto grantee's heirs, successors and assigns all of that certain
real property with the tenements, hereditaments and appurtenances
thereunto belonging or in anywise appertaining, Situated in the
County of Jameson , State of Oregon, described as follows;
to wit:
A 10 foot wide public utility easement, lying 5.00 feet on
each side of the following described line:
Commencing at the Northeast corner of Lot 1 in Block V of
Railroad Addition to the City of Ashland, Jackson County, Oregon;
thence North 74~ 08' 52" West, along the Southerly right-of-way
of "A" Street, 122.13 feet to the POINT OF BEGINNING; thence
leaving said right-of-way, South 07~ 10' 57= West, 52.22 feet;
thence South 17° 09' 07" West 152.00 feet to the terminus of this
easement. The side lines of this easement to be shortened or
lengthened to begin on the Southerly right-of-way of "A" Street.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DE-
SCRIBED IN THIS INSTRUMENT IN VIOLATION OF* APPLICABLE LAND
USE LAWS AND R£GULkTIONS. BEFORE SIGNING OR ACCEPTING
THIS INSTRUMENT. THE PERSON ACQUIRING FEE TITLE TO THE
PROPERI'Y SHOULD CHECK WITH THE APPROPRIATE CITY OR
COUNTY PLANNING DEPARTMENT TO VERIFY APPNOVED USES.
To have and to hold the same unto the said grantee and grantee's
heirs, successors and assigns forever.
The true and actual consideration paid for this .transfer, stated
In construing this easement and where ~he context, so requires, the
singular includes the p&ural and all grammatical Changes shall be
implied to make the provisions hereof apply, equally to :corporations
and to individuals. ·
