EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that HAROLD KEENER and
FLORENCE E. KEENER, husband and wife, do hereby grant an easement unto the
CITY OF ASHLAND, a municipal corporation of the State of Oregon, for and in
consideration of FIVE HUNDRED DOLLARS ($500.00) to be credited against the future
Nevada Street Improvement Assessment to be levied against lot 39 1E 4BD 1901.
Said improvement has been ordered and authorized by Ordinance no. 2540. The
easement is for the construction and continued ·maintenance of a reinforced concrete
headwall and wing-wall to be built onto the existing corrugated metal arch over
Ashland Creek and which easement is over. the property situated in Jackson County,
Oregon, described as follows, to-wit:
Commencing at a 2-inch iron pipe with 3-inch bronze disc monumenting
the Northeast corner of D.L.C. No. 40, Township 39 South, Range 1 East
of the Willamette Meridian, Jackson County, Oregon; thence South 89°
49'10" East, 132.00 feet to the West line of D.L.C. No. 41, said township
and range; thence North 00°19'02`' East (deed record North 00°17' East)
along said West line, 613.80 feet to the Southerly line of Nevada Street;
thence North 89°49'10" West (deed record North 89°53' West) along said
Southerly line, 91.75 feet to the True Point of Beginning; thence continue
North 89°49'10" West, 25.00 feet to the average centerline of Ashland
Creek; thence South 34°49'10" East along said centerline, 9.16 feet;
thence South 89°49'10'` East, 19.75 feet; thence North 00°10'50'' East
The Grantors warrant that they are the owners of said real property free and
dear and all liens and encumbrances whatsoever, except those of record on the below
date.
The Grantee shall have the right to go upon the above described premises for
the purpose of installing and maintaining said concrete headwall and wingwall.

This instrument will not allow use of the property described in this instrument in
violation of applicable land use laws and regulations.
