FINDINGS,
CONCLUSIONS
AND ORDERS
RECITALS:
1) Taxlot 1900 of 391E 14CB is located at the southeast corner of
Siskiyou Boulevard and Mary Jane Avenue and is zoned R-3, Multi-Family
Residential.
2) The applicant is requesting Site Review approval for an 18-unit
apartment complex. Site improvements for the site are outlined on the
site plan on file at the Department of Community Development.
3) Criteria for the approval of a Site Review are found in Chapter
18.72.050 of Ashland's Municipal Code. This Chapter regulates the
necessary improvements to any site that is being changed in use or ex-
panded. The criteria require that all applicable City ordinances have
been and will be met, that all requirements of the Site Review Chapter
be met and that the site design complies with any guidelines that the
City Council may have adopted for implementation of this chapter.
4) The City Council, following proper public notice, held
a Public Hearing on October 4, 1988, at which time testimony
was received and exhibits were presented. The City Council
approved the application subject to conditions pertaining to the
appropriate development of the site.
Now, therefore,
The City Council of the City of Ashland, finds, concludes
and recommends as follows:
SECTION 1. FINDINGS
1.1 The City Council hereby incorporates by reference
the'Staff Report and accompanying slides noted as "Exhibits A and
B", the findings submitted by the applicant noted as "Exhibit
C, the Site Plan submitted by the applicant noted as "Exhibit D",
letters written by affected property owners noted as "Exhibit E" and
the minutes from the public hearing on this proposal held on
October 4, 1988, noted as "Exhibit F".
SECTION 2. CONCLUSORY FINDINGS
2.1 The City Council finds that it has received all
information necessary to make a decision based on the Staff
Report, public hearing testimony and the exhibits received.
2.2 The City Council finds that the proposed request to
construct an 18-unit apartment complex complies with the criteria
outlined in the Site Design Chapter 18.72.050.
The parking area is designed to accommodate 29 vehicles (code
requires 29.25 spaces), plus the one required handicap space. It
has adequate back-up space to allow cars to enter Mary Jane Avenue
in a forward manner and meets the 7 percent landscaping
requirement, which includes buffering and construction of a solid
wood feRce along the perimeter.
The units have their primary orientation toward the street rather
than the parking area, as required, and pedestrian access to the
units from the street and sidewalk has been provided.
Several neighbors were concerned with the increased traffic flow on
Mary Jane Avenue. Traffic generation is not a concern addressed at
Site Review. Mary Jane Avenue, however, has low traffic flows , and
additional traffic near its intersection with Siskiyou Boulevard
will not significantly impact these traffic flows.
The Site Review chapter also states that the Council shall
require developments "to provide access to lower order streets
rather than a major collector or arterial street." (18.72.070 N.)
The applicant has complied with this requirement by providing access
to the development from Mary Jane Avenue rather than from Siskiyou
Boulevard. An additional curb cut and access onto Siskiyou
Boulevard by this development would create an additional traffic
safety problem, and could also reduce the capacity of Siskiyou by
additional traffic entering at another point, slowing through
traffic.
The driveway access to this development is 40', center to center,
from the driveway of the adjacent single family residence on Mary
Jane Avenue. The Site Review Chapter states that distances between
driveways on residential streets shall be 50'. The City Council
believes that this applies when the two driveways are serving uses
which would require Site Reviews, and generate larger amounts of
traffic than a single home. The construction of a single family
home does not require a Site Review. The Council believes that
the purpose of this section is to ensure that higher use driveways
are spaced at adequate distances to provide vision clearance and
increase traffic safety.
The City Council feels that this is a commendable design for
this parcel, and meets the criteria for approval of a Site Review.
2.3 The Council hereby adopts the applicant's findings
as submitted.
SECTION 3. DECISION
3.1 Based on the record of the Public Hearing on this
matter, the City Council concludes that the proposal
for an 18 unit apartment complex located at the southeast corner of
Mary Jane Avenue and Siskiyou Boulevard complies with all relevant
criteria stated in the Site Review Chapter 18.72.
Therefore, based On our overall conclusions, and upon the
proposal being subject to each of the following conditions,
we approve Planning Action #88-080. Further, if any one or
more of the conditions below are found to be invalid, for
any reason whatsoever, then Planning Action #88-080 is denied.
The following are the conditions and they are attached to
the approval:
1) That a revised landscaping plan based on the re-designed
site plan be submitted for review and approval by the Tree
Commission and Staff Advisor, and that this plan include a 6'-0"
high, site obscuring cedar fence with a 3'-0" wide planter with
vegetation a minimum of 3'-0" high along the south side of the
property.
2) That pedestrian accessways be provided from the units
facing Siskiyou Boulevard down to the bike path.
3) That a sidewalk be provided along Mary Jane Avenue, and be
done under permit with the Public Works Department.
4) That the parking area be paved and striped prior to the
issuance of a Certificate of Occupancy for the structures.
5) That all landscaping be installed prior to the issuance of
a Certificate of Occupancy for the structures.
6) That all trash areas be screened.
7) That a drainage plan be provided for review by the Public
Works Department at the time of building permit application, and
measures shown on the plan to accommodate spring or other non-TID
drainage surface flows.
8) That any work done in the State Highway right-of-way be
subject to approval by the State Highway Division.
9) Provide all electric services as required by the City
Electric Department.
10) That street trees be installed along the Mary Jane and
Siskiyou frontage, 1 tree/30' frontage prior to issuance of a
Certificate of Occupancy for the structures.
11) Suggest that all the units be built to energy efficient
standards of the City of Ashland.
12) That an additional pedestrian access be provided off of
the bike path along Siskiyou to the sidewalk to the east of Unit 1.
13) That there be provided one handicap parking space (space
#25 on the submitted site plan) and that each apartment unit have
one designated space.
14) That wheel stops be provide for each parking space.
15) That the submitted site plan be revised to show a 20'
wide driveway.
16) That the submitted site plan be revised to show a 20'
side yard setback along Mary Jane Avenue.
