IN THE MATTER OF PLANNING ACTION #88-182, REQUEST FOR A )
CONDITIONAL USE PERMIT AND SITE REVIEW FOR THE CON- ) FINDINGS,
STRUCTION OF 29 MOTEL UNITS LOCATED SOUTHWEST OF THE ) CONCLUSIONS
INTERSECTION OF CHURCHAND NORTHMAIN STREETS. ) AND ORDERS
APPLICANT: JOHN WARREN )

RECITALS:
1) Tax lot 4700 of 391E 9BB is located southwest of the intersection
of Church and North Main Streets and is zoned C-i; Commercial.
2) The applicant is requesting a Conditional Use Permit and Site
Review for the construction of 29 motel units. Site improvements are
outlined on the site plan on file at the Department of Community
Development.
3) The criteria for approval of a Conditional Use Permit are found in
Chapter 18.104 and are as follows:
A. The proposal is in conformance with the Comprehensive Plan.
B. The location, size, design and operating characteristics of the
proposed development are such that the development will be reasonably
compatible with and have minimal impact on the livability and
appropriate development of abutting properties and the surrounding
neighborhood.
C. In determining the above, consideration shall be given to the
following:
1) Harmony in scale, bulk, coverage and density.
2) The availability and capacity of public facilities and
utilities.
3) The generation of traffic and the capacity of surrounding
streets.
4) Public safety and protection.
5) Architectural and aesthetic compatibility with the surrounding
area.
The criteria for approval of a Site Review are found in Chapter 18.72
and are as follows:
A. Ail applicable city ordinances have been met and will be met by the
proposed development.
B. Ail requirements of the Site Review chapter have been met.
C. The site design complies with the guidelines adopted by the city
Council for implementation of this chapter.
4) The Ashland city Council following proper public notice, held
a Public Hearing on May 2, 1989, at which time testimony
was received and exhibits were presented. The City Council
approved the application subject to conditions pertaining to the
appropriate development of the site.
Now, therefore,
The City Council of the City of Ashland, finds and concludes
as follows:
SECTION 1. FINDINGS
1.1 The City Council hereby incorporates by reference
the Staff Report noted as "Exhibit A", the findings submitted
by the applicant noted as "Exhibit B", the Site Plan and profile
submitted by the applicant noted as "Exhibit C" and the minutes
from the public hearing on this proposal held on May 2, 1989,
noted as "Exhibit D".
SECTION 2. CONCLUSORY FINDINGS
2.1 The City Council finds that it has received all
information necessary to make a decision based on the Staff
Report, public hearing testimony and the exhibits received.
2.2 The City Council finds that the proposal for the construction
of 29 motel units meets all relevant criteria of the Conditional
Use Chapter 18.104 and Site Design and Use Standards Chapter 18.72.
The City Council believes a motel use is appropriate for this site
and would have less of an impact than a retail use. A retail use
is permitted outright in a Commercial zone and has an allowable
building height of 40'. The proposed motel has an average building
height of 32', well below the 40' height allowed in the C- 1 zone.
Also, the impacts from traffic coming to and leaving the site would
be greater in the operation of a retail use. This parcel is in
immediate walking distance from the downtown, allowing occupants
of a motel to leave there automobiles in the parking lot and seek
shopping, dining and entertainment on foot.
The Council believes that the building is compatible with the
residential neighborhood along North Main and Church Streets. The
submitted site plan and elevations have considered the surrounding
neighborhood, incorporating pitched roofs with composition shingles
and dormers. The siding material has been revised from the original
brick and stucco to painted wood lap siding. Further, the site plan
complies with Ashland's Site Design and Use Guidelines in that the
primary orientation of the building is towards North Main Street
with parking oriented to the rear of the building.
2.3 The Council hereby adopts the applicant's findings
as submitted.
SECTION 3. DECISION
3.1 Based on the record, the City Council concludes that the
proposal for the construction of 29 motel units is supported by
evidence contained in the whole record.
Therefore, based on our overall conclusions, and upon the
proposal being subject to each of the following conditions,
we approve Planning Action #88-182. Further, if any one or
more of the conditions below are found to be invalid, for
any reason whatsoever, then Planning Action #88-182 is denied.
The following are the conditions and they are attached to
the approval:
1) That all landscaping be installed prior to the issuance of a
Certificate of Occupancy for the structure.
2) That all parking areas be paved and striped prior to the issuance
of a Certificate of Occupancy for the structure.
3) That the one-way entrance off of North Main be clearly marked as
"NO EXIT" from the parking lot side.
4) That approval be obtained from the Public Works Department prior
to the installation of the brick pavers within the public
right-of-way. Also, that the applicant's sidewalk plans comply with
the guidelines for downtown sidewalk areas as established by the
Downtown Plan Advisory Committee.
5) That the applicant contact and coordinate construction with the
Head of the Electric Department prior to the issuance of building
permits to ensure adequate clearance from existing power lines.
6) That a drainage plan be submitted for review and approval by the
Public Works Department at the time of building permit application.
7) That all work done within the public right-of-way of North Main
Street be done only under approval of the State Highway Division.
8) That the site plan is to comply with the Tree Commission
recommendations, to the approval of the Staff Advisor.
9) That the applicant is to furnish proof of Clear Title to the
entire parcel as of June 15, 1989.
