KNOW ALL MEN BY THESE PRESENTS that DONALD P. THOMAS and RUBY
HART THOMAS hereinafter cal3ed Grantors, for and in cons~.deration of ONE
EUNDRED THREE THOUSAND DOLLARS ($103,000.00), to Grantors paid by THE
CITY OF ASHLAND, a Municipal Corporation of the State of Oregon,
hereinafter called the Grantee, do hereby grant, bargain, sell and
convey unto the said Grantee and unto Grantee's successors and assigns,
that certain real property, with the tenements, hered~taments and
appurtenances thereunto belonging or appertaining, situated in the
County of Jackson, State of Oregon, described on Exhibit "A", which is
attached hereto and incorporated herein and which bears the notation of
being Order 72553 and pages two and three of said Order.
SUBJECT TO:
1. Rights of the public in and to any portion ].ying within
the Jimits of public roadways, if any, and/or rights of private parties
over any portion lying within existing roadways or driveways not
disclosed by the public records
2. A 60 foot easement for ingress an egress granted and
reserved in deeds recorded as Document No.s 68-09413; 68-09414;
71-?.3933; 75-09410: 75-09411~ and 75-09412, Official Records of Jackson

Telephone and Telegraph Company, including the terms and provisions

TO HAVE AND TO HOLD the above described and granted premises
unto the said Grantee and Grantee's successors and assigns forever.
And said Grantors hereby covenant to and with said Grantee
and Grantee's, successors and assigns, that Grantors are lawfully seized
in fee simple of the above granted premises, free from all encumbrances,
except as herein set forth, and that Grantors will warrant and forever
defend the said premises and every part and parcel thereof against the
lawful claims and demands of all persons whomsoever, except those
claiming under the above described encumbrances.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCRIBED
IN THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS AND
REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE PERSON
ACQUIRING FEE TITLE TO THE PROPERTY SHOULD CHECK WITH THE APPROPRIATE
CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY APPROVED USES.
