KNOW ALL MEN BY THESE PRESENTS, that MARVIN E. MILLER and
MAXINE M. MILLER, hereinafter called the Grantors, for and in
consideration of ONE DOLLAR ($1.00), to Grantors paid, the receipt
whereof hereby is acknowledged, does hereby release remise and
quitclaim unto the CITY OF ASHLAND, a Municipal Corporation of the
State of Oregon, hereinafter called Grantee, all the Grantor's
right, title and interest in that certain real property with the
tenements, hereditaments and appurtenances thereunto belonging or
in any way appertaining, situated in the City of Ashland, County
of Jackson, State of Oregon, described as follows:
That portion of Nevada Street previously vacated by Ordinance
number 204 lying South of the following described line,
commencing at the Northeast corner of Donation of Land Claim
Number 40, Township 39 South, Range 1 East of the Willamette
Meridian, Jackson County, Oregon, monumented by a 2" pipe with
Brass Cap; thence, South 89o52'57'' East, 454.28 feet to the
center line of Oak Street monumented by a brass disk in
monument case; thence, along said center line North 0F57'21"
East, 658.59 feet; thence North 89°59'21'' East, 159.14 feet
to the Southeast corner of parcel number 1 as shown on that
minor land partition recorded in Volume 2, page 68 of "Minor
Land Partitions" in Jackson County, Oregon being a point on
the North right of way line of Nevada Street which is 23.5
feet North of the center line of said street for the True
Point of Beginning; thence North 89°59'21'' East 620 feet more
or less to the Westerly boundary of Tract 26 of Ashland Acres
(a recorded subdivision) for the terminus of this line. Also
including a 10 foot wide slope and public utility easement
North of and adjacent to the previously described line.
This instrument will not allow use of the property described
in this instrument in violation of applicable land use laws and
regulations. Before signing and accepting this instrument, the
person acquiring fee title to the property should check with the
appropriate City or County Planning Department to verify approved
uses.
