WITNESSETH:
WHEREAS: The first party is the record owner of the following described real estate in Jackson
County, State of Oregon, to-wit:

and has the unrestricted right to grant the easement hereinafter described relative to said real estate;
NOW, THEREFORE, in view of the premises and in consideration of One Dollar ($I) by the second
party to the first party paid and other valuable considerations, the receipt of all o£ which hereby is acknowl-
edged by the first party, they agree as follows:
The first party does hereby grant, assign and set over to the second party

Commencing at the Northwest corner of Lot One (1) in Block
Two (2), Ashland Business Park in Jackson County, Oregon,
according to the Official Plat thereof, now of ~ecord; thence
North 00° 02' 33" East, along the Easterly right-of-way line Of
Jefferson Avenue, 109 .79 feet to the POINT OF BEGINNING: thence
continue North 00° 02' 33" East, along said Easterly right-of-way
line, 30.00 feet; thence South 890 50' 37" East 78.00 feet; thence
North 00° 09' 23" E~st 24.00 feet; thence South 89° 50' 37" East
10.00 feet; thence South 00. 09' 23" West 49.00 feet; thence South
39° 50' 37" East ~0.00 feet; thence South 00° 09' 23" West 20.00

The second party shall have all rights of ingress and egress to and from said real estate (]ncluding the
right from time to time, except as hereinafter provided, to cut, trim and remove trees, brush, overhanging
branches and other obstructions) necessary for the second party's use~ enjoyment, operation and maintenance of
the easement hereby granted and all rights and privileges incident thereto.
Except as to the rights herein granted, the first party shall have the full use and control of the above de-
scribed real estate.
The second party hereby agrees to hold and save the first party harmless from any and all claims of
third parties arising from second party's use of the rights herein granted.

Commencing at the Northwest corner of Lot One (1) in Block
Two (2), Ashland Business Park in Jackson County, Oregon,
according to the Official Plat thereof, now of record; thence
North 00° 02' 33" East, along the Easterly right-of-way line of
Jefferson Avenue, 124.79 feet to a lead plug set in concrete for
the POINT OF BEGINNING; thence continue North 00° 02' 33" East
along said Easterly right-of-way line 119.78 feet; thence along
the arc of a 20.00 foot radius curve to the right (the long chord
to which bears North 45° 05' 58" East 28.31 feet) an arc distance
of 31.46 feet to a point on the Southerly right-of-way line of
Washington Street; thence South 89° 50' 37" East, along said
Southerly right-of-way line 203.66 feet to the Northwest corner
of the tract described in Jackson County Instrument No. 77-09634;
