KNOW ALL MEN BY THESE PRESENTS:
That
Mark Rothman and Patricia Rothman
do hereby grant an Easement unto the CITY OF ASHLAND, a Municipal corporation
of the State of Oregon, for and in consideration of One Dollar ($1.00)
which Easement is for installation and perpetual
maintenance of public utilities
and which Easement is over the property situated in Jackson County, Ore£on,
described as follows, to-wit: A tract or parcel of land situated in
the South Half, of the Northeast Quarter, of Section 16, Township 39
South, Range 1 East, Willamette Meridian, Jackson County, Oregon being
more fully described as follows:
Commencing at the Quarter Corner common to Sections 9 and 16, said
township and range; thence East, 1601.43 feet; thence South 1858.38
feet to a found 5/8 inch iron pin situated in the right of way of Beach
Street for the .TRUE POINT OF BEGINNING; thence North 89°07'50'' West,
27.73 feet, along that boundary line by agreement recorded as Document
No. 70-08063 of the Deed Records of Jackson County, Oregon, to a 1 inch
Iron Pipe; thence continue North 89° 07'50" West, along said boundary
agreement line, 130.19 feet; thence South 00°47'55" West, along said
boundary agreement line, 5.00 feet; thence North 89°07'50" West, 5.00
feet; thence North 00° 47'55" East, 22.53 feet, to a point on the
Northerly boundary of that parcel of land as described in Vol. 595,
Page 486, Deed Records of Jackson County, Oregon; thence South 00°
47'55" West, 7.61 feet; thence South 89 07'50" East, 157.75 feet; ~
thence South 00° 10'00" East, 10.00 feet to the Point of Beginning. ~'
Excepting that portion of above described tract lying within the Beach
Street right-of-way
The Grantors warrant that they are the owners of said real
property free and clear of all liens and encumbrances whatsoever, except
those of record on the below date.
