BOUNDARY LINE AGREEMENT
THIS AGREEMENT entered into this /~_~ ~ day of ~. ~.c.~;_/~, 1988,
by and between William C. Colle¥ and Nelda Jo Colle¥, husband and wife,
hereinafter referred[ to as "First Parties", and the City of Ashland, a
municipal corporation of the State of Oregon, hereinafter referred to as
"Second Party",
WITNESSETH:
WHEREAS, First: Parties are the record owners in fee simple of the
property described in that certain Warranty Deed recorded as instrument
no. 87-22692 of the Official Records of Jackson County, Oregon, and
WHEREAS, Second Party is the record owner in fee simple of the alley
running northeasterly from Van Ness Avenue (formerly known as Mechanic
Street) and situated[ between lots 1 and 2 of block 11 of the City of
Ashland in accordance with the official 1888 map thereof, and
WHEREAS, the common boundary line between the property of First
Parties and the property of Second Party has prior hereto been subject to
question as to the exact location thereof and a line has now been surveyed
and monumented between the properties which is described as follows:
Commencing at a found 3/4 inch iron pipe situated at the
centerline intersection of North Laurel Street and Van Ness
Avenue in'the City of Ashland, Oregon, in the Southeast quarter
of Section 5, Township 39 South, Range 1 East of the Willamette
Base and Meridian, Jackson County, Oregon; thence North 63o43'30''
West along the centerline of Van Ness Avenue, 351.03 feet to a
found 1/2 inch iron pipe situated at the centerline intersection
of Skidmore Street and Van Ness Avenue; thence leaving said
centerline and normal therefrom, North 26°16'30'' East, 30.00 feet
to a point in the Northeasterly right of way line of Van Ness
Avenue; thence North 63°43'30'' West along said right of way line,
288.715 feet to a 5/8 x 30 inch iron rod with a red plastic cap
marked 'Wit. Cor. RLS 759' for the TRUE POINT OF BEGINNING;
thence leaving said right of way line, North 26"12'13'' East,
124.95 feet to a 5/8 x 30 inch iron rod with a red plastic cap
marked 'Wit. Cor. RLS 759' and situated in the Southerly boundary
line of that tract or parcel of land as set forth in Volume 554,
Page 36 of the Deed Records of Jackson County, Oregon and there
terminating.
AND WHEREAS, the parties hereto, for their mutual benefit, desire to
make said described line the common boundary line between their respective
properties a matter of record, NOW THEREFORE,
IN CONSIDERATION OF THE PREMISES, and the mutual benefits hereunder,
the parties agree as follows:
1. The monumented line described above shall henceforth be the
common boundary line between the properties of First Parties and Second
Party hereinbefore described.

2. First Parties hereby release, remise and quitclaim to the Second
Party their right, title and interest in and to all property situated
Northwesterly of said described monumented line.
3. Second Party hereby release, remise and quitclaim to the First
Parties, their heir's and assigns, all its right, title and interest in and
to all property situated Southeasterly of said described monumented line.
IN WITNESS WHEREOF, the parties have hereunto set their hands and
seals the first day hereinabove mentioned.
