KNOW ALL MEN BY Tu~-SE PRESENT that the undersigned, hereinafter referred to as
Grantees (whether singular' or plural), hereby covenant and agree that they shall
not, by reason of their ownership or occupation of the following described real
property, protest or bring suit or action against =he Ashlan~__Municipal Ai.~or~ ~
or the City of Ashland for aviation related noise, proper~y ~amage or personal
injuries resulting from activities at or co~mected with the Ashland Municipal
Airpor~ when such activities conform :o the then existing rules an~ regulations
of said airport and t_he applicable federal ~ regulations and no negligence on
the pa--~ of said a{rpor~ is involved. The real prope_--Ty of Grantees subjec~ .
to t. his covenant and agreement is situated in the County of Jackson, S~ate of
Oregon, and 6escribed as follows:

This covenant and agreement is made and executed by the Grantee in consideration
of the City _of Ashland having no. objection to ~he Construction of a single
family residence for Grantees use, which real ~rope_--Ty is loca:ed in
t. he airport concern area of the Ashland Municipal Airport. The execution of-
this covenant an~ agreement by Grantees is recommended by the City of Ashland.
This agreement is executed for the protec'-ion and benefit of the Ashland ~n~cipal
Airport and the City of Ashland interest i~ said a~or= ahd to-~revent development
in' adjacent lands to said airport which will interfere with the con~.inued 6pera~ion
existent and develo_=me~t of said ~.-port. This covenant an~ agreement is in=ended
to be bind3_ng UPon the Grantees, 't. heir heirs, assigns and successors and inure ~o
the benefit of the City of Ashland ar~ the A~-por~., their successors and assigns.
