the City of Ashland, and agree to bear the proportionate payment of associated costs. This
agreement is to be binding upon myself/ourselves, my/our heir(s), executors, and assigns, and
it is my/our express intention that this agreement shall run with the land, so that fulfillment
of the items listed below shall be binding upon future owners of the property.

Commencing at a 1 inch diameter iron rod monumenting the Accepted Southwest
one-sixteenth section corner of Section 5; said Township and Range; thence

boundary line of Nickel Plate Addition, as now recorded, 417.50 feet; thence
leaving said centerline, South 00°31'54'' East, 23.5 feet to a found 3/4 inch
iron pipe situated in the Southerly right of way of Wimer Street and being
the True Point of BeQinnin~; thence North 89°57'55'' East along said Southerly
right of way, 225.56 feet to a found 3/4 inch iron pipe situated at the right

corner of Parcel No. 2 of City of Ashland Minor Land Partition M76-277 and
filed for record the 22nd day of February, 1977 at 2:31 o'clock P.M. and
recorded in Volume t at page 67 of "Minor Land Partitions" in Jackson County,
Oregon; thence South 00~42'19'' East and parallel to Wrights Creek Drive, lO0.O0
feet to a found 5/8. inch iron pin situated at the Southwest corner of said
Parcel No. 2 and also being situated in the Northerly right of way of Grandview
Drive; thence along said Northerly right of way the following courses: along
the arc of a 173.50 foot radius curve to the left, the radial bearings "in and
out" are South 01~:40'49'' West and North 24°30'49'' West (the central angle is
26 degrees ll minutes and 38 seconds) 79.32 feet to a found 3/4 inch iron pipe;
thence along the arc of a 266.267 foot radius curve to the right, the radial
bearings "in and out" are North 24°30'4g'' West and South 13°lO'O0'' East (the
central angle is ll degrees 20 minutes and 49 seconds) 52.73 feet to a found
5/8 inch iron pin; thence leaving said street right of way, North 00°31'54"
West, 576,39 feet to the point of beginning. Containing 1.706 Acres, more or
