Agreement concerning Senior Citizens bus
As the Council is aware, the Ashland Senior Program, in cooperation
with the Soroptimists Club of Ashland was successful in obtaining a
Federal Grant with the assistance of the State Transportation Department,
for the replacement of the senior van with a new 24 passenger bus°
Program regulations require that the bus be owned by a private,
non-profit organization such as the Soroptimists. As a part of the
proposal, the Soroptimists originally planned to insure the bus as
both the registered and legal owner. When insurance bids were received,
the insurance was $1,200 higher than anticipated since the City of Ash-
land was no longer involved as registered owner°
Senior Program Director Kay Stein has secured approval to have
the City listed as registered owner and secure the insurance in its
name° The Soroptimists would still pay for the premium as in the past.
The only Federal requirement is the attached "13(c) Labor Protection
Warranty Assurance" under which the City agrees that it will not dis-
place employees as a result of the receipt of the grant for bus acquisi-
tiono Over 25 public agencies in Oregon have signed such assurances.
RECOMMENDATION: I have carefully reviewed any possible exposures created
this waiver with Eric East, State Transportation Planner, and do not
believe we are taking a significant risk by signing the assurance° I
therefore recommend that the Mayor and City Recorder be authorized to
sign the assurance on behalf of the City.

13(c) Labor Protection Warranty Assurance
As a condition of the receipt of federal transit assistance under
Section 16(b)(2) of the Surface Transportation Act of 1978 the
-- CitX of Ashland (hereinafter referred to as Lessee) hereby

certifies that it has read, and understands, the ~pecial Section 13(c)
~arranty for Application to the small urban and rural areas, and the
National (Model) Section 13(c) agreement executed July 23, 1975.
The Lessee also assures the Public Transit Division that, as a condition
of the receipt of transit assistance under Section 18, it agrees to
be bound by the terms and conditions of the Special 13(c) Warranty for
the protection of transit employees affected by the project. The Lessee
also agrees to be the designated legally responsible party for employees
of any other surface public transportation provider in the transportation
service area of the Project. Lessee also understands that the warranty
is enforceable by any covered employee or his representative.
