Revised Agreement for 59 Winburn Way
Here is a draft of the agreement we discussed several we,eks ago which
will replace the interim agreement for the management of the building at
59 Winburn Way.
Ken Mickelson bas reviewed it and made a few modifications. Before
sending it on to the full Council, I would like you to look it over tO
see if it covers all the points we discussed.
Susan Reid also is being sent a copy due to her concern about the
meeting room for the Youth Task Force.

This agreement entered into thzs~_~}~Jday of~5'~~i~, 198~,
by and between the CITY OF ASHLAND hereinafter ca-~ and
the ASHLAND PARKS & RECREATION COM2~ISSION, hereinafter cal%ed
"Commission", both of whom agree as follows:
RECITALS
The contractural services agreement dated July 8, 1983 is hereby
cancelled, and the City desires to have the Commission continue to
a~inister the use and maintenance of certain portions of the City-
owned building at 59 Winburn Way; and
Commission is willing to accept this responsibility subject to
the terms and limitations se~ forth herein.
AGREEMENT
1o General. City hereby contracts with the Commission to orovide
management for the building as follows:
a. To schedule events and collect building rental fees for
the following areas:
(1) Auditorium/stage area.
(2) Fireside Room at N.E. corner°
(3) Conference Room on S. side of auditorium°
(4) Kitchen area.
(5) Storage Room between mens & womens restrooms.
b. To provide janitorial services for the building, except
for rooms and areas under the control and use of City as
stipulated below.
2o Compensation. City agrees to pay for the cost of all repairs
and ~furbis z~g to the building.
3. 'Rental Fees. Commission agrees to remit quarterly, all rental
fees and revenues derived from use of the building°
4. Utilities. City agrees to pay for all utilities associated with
operatio'n of the building.
5. Arleas not~?ubje'ct_.to rental. The following areas shall be
under use and control o~ the City and not available for rental.
a. The three offices at the S.E. corner previously used for
Commission administrative offices.
b. The office at the N.E. corner oreviously used by the Senior
Program Director°
c. All storage rooms exceot the room between the mens & womens
restrooms.
d. The attic area.

6. Common Areas. Areas for joint use shall include the public
restrooms, hallways and porch areas.
7. Personal Property Storage. Existing cabinets in storage areas
presently used by private clubs who rent the building may continue
to be used.
8. Terms. This agreement shall become effective upon its acceptance
by the parties, and shall continue on a year to year basis, and may
be cancelled by either party on thirty (30) days advance notice.

59 Winburn Way.
