EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that the CITY OF
ASHLAND, OREGON, a municipal corporation of the State of Oregon,
hereinafter referred to as "Grantor," hereby grants, bargains
and sells and conveys an Easement for ingress and egress and for
the installation and maintenance of sewer and water lines, elec-
trical, telephone, and cable television lines, and irrigation
water lines to DAVID R. LEWIS and RHONDA LEWIS, husband and wife,
their heirs, successors, and assigns, hereinafter referred to
as "Grantees," over land situated in the County of Jackson,
State of Oregon, as more particularly described in Exhibit "A"
which is attached hereto and incorporated herein and is designated
as Acc. No. 39 1E 16BA 700.
Said Easement shall be appurtenant to the land
described in Exhibit "B" which is attached hereto and incorporated
herein with said land being in the County of Jackson, State of
Oregon.
Said Easement is perpetual in nature and non-exclusive.
Ail costs involved in the use of this Easement shall be borne by
the Grantee.
Further, said Easement is subject to the following
conditions:
1. Easement shall be limited in use to one single
family residence.
2. In the event that Long Way is extended and improved,
the City of Ashland shall in no way be held responsible for
damages to private driveways resulting from adjustments made
in street grade. Any costs incurred by the grantee in relo-
cating utility lines, water and sewer lines or irrigation water
lines located within the easement or in adjustment of remaining
driveway sections shall be borne entirely by the grantee.
3. The driveway shall connect to the existing
improved street by a standard driveway approach. The grantee

shall acquire the necessary construction permit from the City
of Ashland, Engineering Division. All work within the easement
area shall be done in accordance with the City of Ashland stan-
dard specifications and to the approval of the City Engineer.
The consideration for this Easement is ONE DOLLAR
($1.00) and other good and valuable consideration, the receipt
of which is hereby acknowledged.

Personally appeared L. GORDON MEDARIS, who being
duly sworn did say that he is the Mayor of the City of Ashland,
and NAN FRANKLIN, who being duly sworn did say that she is the
City Recorder for the City of Ashland, and that said Easement
was signed on behalf of said City by authority of its City
Council; and they acknowledged said instrument to be its
voluntary act and deed.

EXHIBIT "A"
Beginning at the Southwest corner of Lot 6 of
Block 2 of the Stratford-on-Avon Subdivision
in the City of Ashland, Jackson County, Oregon;
thence North 89048'30'' East 31.20 feet; 'thence
North 30 feet, more or less, to the southerly
line of the Long Way Cul-de-Sac in said subdivi-
sion; thence westerly along said cul-de-sac line
to a point which lies North 37.77 feet from the
point of beginning, thence South 37.77 feet to
the point of beginning.
