The intent of this letter is to set forth the conditions under which you agreed to give the easement. The conditions are as follows and are items which the City of Ashland agrees to do: The south end of Clay Street between the end of the pavement and your paved driveway (approximately 420 feet) will be graded and rocked with 3/4" - 1" crushed rock, and drainage ditches will be cleaned and or re-established. This work will be done during the summer of 1983. The present schedule calls for completion of the south Clay Street portion of the job about September 1, 1983. We will however, schedule the street work for within 15 days of the actual completion date of the pipe work, whenever that is. The City will allow you to connect one four-inch sewer lateral to the City owned sanitary sewer at a point near the lower end of your driveway as shovm on the attached plat. There will be no charge for this connect but you will, of course, be subject to the regular out-of-City monthly service charge at whatever rate is in effect for other out-of-City services. This rate does change from time to time. A portion of the easement is in the roadway which serves the Frazier residence and you noted some concern for his access. The City has discussed this with Mr. Frazier and he is in agreement with the City's Merilyn Coe April 13, 1983 Page Two proposed rehabilitation plan. Upon compilation of the project the City will regrade the road and replace any paved or rocked areas in kind. That is to say, with pavement or rock to match that which is removed, dis- turbed or damaged. Prior to any work on that portion we will meet to come to an agreement as to what is there now so there will be no disagreement later. It appears to us that the portion of the pipeline insta- llation through your pasture, westerly of Clay Street, should not take any longer than two weeks. We will place a provision in the specifications whereby if this installation takes longer than that, the contractor will be required to erect a temporary fence around the con- struction area so that you can return your horses to your pasture. The fence must be satisfactory to you and I am thinking of metal posts spaced ten feet apart with the fence being woven wire about 64 inches high. Please let me know if this is not satisfactory. I think this covers everything we discussed earlier. If so, we would appreciate your signing and returning one copy of this letter and the attached agreement.
