A RESOLUTION CALLING FOR A SPECIAL ELECTION ON THE 20 DAY OF ~.LAY, 1980, FOR THE PURPOSE OF SUBMITTING TO TttE LEGAL VOTERS OF THE CITY OF ASHLAND A ~ASURE CALLING FOR AN AMENDMENT AND REVISION OF TttE 1899 CHARTER OF THE CITY OF ASHLAND, JACKSON COUNTY, OREGON, AS AMENDED, TO PROVIDE FOR THE ALLOCATION OF A PORTION OF THE TRANSIENT OCCUPANCY TAX TO BE USED FOR THE PROMOTION OF ASHI.AND. BE IT RESOLVED BY THE CITY OF ASHLAND, as follows: SECTION 1. A Special Election is hereby called to be held in the City of Ashland, Oregon, on Tuesday, May 20, 1980, from 8:00 a.m. to 8:00 p.m. at which Election there shall be submitted to the legal voters of said City a proposed Charter Amendment which is hereby referred to the voters by the initiative process and reads as follows: CHARTER AN~ID~NT REFERRED BY THE INITIATIVE PROCESS TO THE VOTERS AN ACT To amend and revise the 1899 Charter of the City of Ashland, Jackson County, ORegon, as amended, to provide for a special fund and the allocation of a portion of the Transient Occupancy Tax for the promotion of Ashland: SECTION 1. There is hereby added to the Ashland Charter, a new Article being Article XXIII, which shall read as follows: Article XXIII - Allocation of Transient Occupancy Tax Section 1. Transient Lodging Tax~ Promotional Fund. The council may by ordinance impose and levy a tax not exceeding 6% on gross receipts for the privilege of occupying room or space in any hotel, inn, motel, apartment, or boarding house, mobile home or trailer Dart or court, or any other place in the city where space designated or intended for lodging-occupancy is rented by any person or persons. This Tax shall not apply to hospitals, convalescent or nursing homes, or public institutions, or permanent occupancy as may be defined by ordinance. Minimum rentals to which the Tax shall apply may be fixed by ordinance. The Tax imposed shall be collected by the owner or operator of the rental space in addition to the rental charged, as provided by Ordinance. Section 2. Revenues from such tax shall be received into a special fund created for that purpose, and may be used for general city purposes, as the council may find appropriate; provided, however, that annually a sum equal RDNALD L. BOX 727 ASHLAND, OREGON 9752[3 to the following percentages of the proceeds received by the City from such tax, after providing for the cost of administration and refunds or credits as may be authorized by ordinance, shall be used exclusively for the purpose of promoting, directly or indirectly through contract, the use of the City of Ashland for recreational, cultural, convention and tourist related activities and services. This meaSure shall'become effective July 1, 1980. SECTION 3. The following Ballot Title for the proposed measure is hereby adopted and approved and the following are the Ballot Title and form in which the measure shall appear upon the Ballot at said Special Election: MEASURE SUBMITTED TO THE VOTERS BY THE CITY COUNCIL : : VOTE "YES" OR "NO". That the same persons shall serve as Chairman and Clerks for said Special Election as serve as Chairmen and Clerks for the Primary Election held at the same time and on the same day~ that the respective polling places lawfully designated for the said Primary Election are hereby designated as the voting places for said Special Election; polls will be open from 8:00 a.m. to 8:00 p.m. on the date herein set forth for said Election. The City Recorder is hereby directed to give not less than ten (10) days notice of said Special Election by publication of a Notice thereof in the Daily Tidings, a newspaper of general circulation printed and published in the City of Ashland and by posting Notice thereof in one (1) public place in each Precinct of the City of Ashland. Explanation: The proposed Charter Amendment, if passed, would require 50% of the first $100,000 of the presently existing Transient Occupancy Tax (with declining percentages thereafter) to be used exclusively for the purpose of promoting, directly or indirectly through contract, the use of the City of Ashland for recreational, cultural, convention and tourist related activities and services. The Polling Places for the purpose of this Election are as follows: Precincts 1 and 7 - Lincoln School, 320 Beach Precinct 2 - Womens Civic Center, Winburn Way Precincts 3 and 6 - Ashland Senior High School, Mountain and and Iowa Streets Precincts 4 and 16 - Helman School, 705 Helman Precinct 5 - Briscoe School, 265 North Main Street Precinct 10 - S.O.S.C. Student Union, Siskiyou Blvd. Precincts 11 and 12 - Ashland Junior High, 100 Walker Avenue Precincts 13 and 15 - Bellview School, 1070 Tolman Creek Road The polling Places for said Special Election shall be open between the hours of 8:00 a.m. and 8:00 p.m. The full act of municipal legislation to be voted on at said Special Election is on file and is open for examination at the Office of the City Recorder of the City of Ashland, Ashland City Hall, Ashland, Oregon, and may be inspected by the legal voters of said City.
