Grantors own or are the vendees under a recorded land sale contract of real property
in the City of Ashland, Jackson County, Oregon, which is described as follows and
further referred to in this document as "the property":
Parcel No. 2 of that Land Partition filed for record on the 11th day of June, 1991
and recorded as Partition Plat No. P-60-1991 of "Records of Partition Plats" of
Jackson County, Oregon. (Index volume 2, page 60)
A partition of this property was approved by the City of Ashland ("City") on
Planning Action No.'q~. I0~ . A condition of the approval restricts sale of the partition
lots until Grantors improve Alta Street or Grantors deposit in escrow for benefit of City
a sum sufficient to improve Alta Street to City standards.
1. In consideration of the approval of partition by City, Grantors declare and agree that
the property shall be held, sold, and conveyed subject to the following covenants,
conditions and restrictions, which shall constitute covenants running with the land and
shall be binding on all parties having any right, title or interest in the property and their
heirs, successors and assigns:
Grantors shall not sell any partition lot in the property until Grantors improve
Alta Street or Grantors deposit in escrow for benefit of City a sum sufficient to
improve Alta Street to City standards.
