HomeMy WebLinkAbout2035 Condo Regulations ORDINANCE NO. 2035 AN ORDINANCE AMENDING THE ASHLAND MUNICIPAL CODE RELATIVE TO THE REGULATION OF THE CONVERSION AND CONSTRUCTION OF CONDOMINIU~1S, AND DECLARING AN EMERGENCY. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. A new Section 18.08.102 is hereby added to the Ashland Municipal Code, to read as follows: "18..08.102 Condominiums. 'Condominium' means a dwelling unit tha1: is part of a development under single ownership, and is individually owned. Ii SECTION 2. A new subsection "J" is hereby added to Section J8.,..2.4,~010 (Conditional Uses in the R-2 Zoning district), to read as follows: "J. Condominiums and condominium conversions of rental units, subject to a demonstration of public need and lack of detrimental effE~ct on the supply of rental units or land for such units." SECTION 3. A new subsection "J" is hereby added to Section 18.28.030 (Conditional Uses in the R-3 Zoning district), to read as follows: "J. Condominiums and condominium conversions of rental units, subject to a demonstration of public need and lack of detrimental effect.on the supply of rental units or land for such units." SECTION 4. Section 18.52.010 (Off-street Parking--Generally) of the Ashland Municipal Code, is hereby amended to read as follows: Ir18.52.010 (Off-Street Parking--Generally. In all districts, except those specifically exempted, whenever any building is erected, enlarged, or the use is changed (including conversion of rental units to condominiums), off-street parking shall be provided as set forth in this chapter." SECTION 5. Subsection C (Site Approval Required) of Section 18.54.010 of the Ashland Municipal Code, is hereby amended to read as follows: "(C) All alterations to use types requiring site review which affect the use, intensity of use, floor area, structure location, or significant elements of the site plan or design; including conversion of multiple family rental units to condominiums." SECTION 6. A new Section 15.04.115 is hereby added to the .Ashland Municipal Code, to read as follows: "15.04.115 Condominiums. Structures being converted from multiple- family rental unit use to condominiums shall conform to State Code standards in effect at the time of conversion, and a building per- mit shall be obtained for such conversion." Ordinance - 1 SECTION 7. An emergency is hereby declared to exist based. upon the publi; health, safety and welfare and thi~ ordinance shall become effective upon its passage by the Council and approval by the Mayor. .
