ORDINANCE NO. 1763
AN ORDINANCE AMENDING ORDINANCE NO. 1361 AS AMENDED, BY ADD-
ING ADULT BOOKSTORES AND ADULT MOVIE HOUSES AS CONDITIONAL
USES IN CERTAIN COMMERCIAL DISTRICTS, AND DECLARING AN EMER-
GENCY.
WHEREAS, the Planning Commission and the City Council have held duly
advertised public hearings on the zoning ordinance to properly
classify adult bookstores and adult movie houses; and
WHEREAS, both the Planning Commission and the City Council deem it to be
in the best interest of the citizens of the City of Ashland that
the zoning ordinance be amended as set forth herein;
NOW, THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOllOWS:
SECTION 1. Ordinance No. 1361, Section 14, Subsection (3) is
hereby amended by adding a new paragraph to read as follows:
IIAdu1t bookstores and adult movie
houses, provided the same are loc-
ated a minimum of five hundred (500)
feet from parks, playgrounds, lib-
raries, public or private schools,
excluding colleges and universities."
SECTION 2. That inasmuch as the above uses are not specifically
classified in the zoning ordinance, and that the public health, peace and
safety of the citizens of the City of Ashland require that the provisions
herein be made immediately operative, an emergency is hereby declared and
this ordinance shall be in full force and effect from and after its pass-
age by the Council and approval of the Mayor.
The foregoing ordinance was first read on the 6th day of
February , 1973 and duly PASSED and ADOPTED this20th day of
February , 1973 -
