AN ORDINANCE P~MENDING SECTION 18.68.100 OF THE ASHLAND MUNICIPAL CODE
WHICH RELA'rES TO THE PENALTY FOR ZONING VIOLATIONS AMENDING SECTION
17.32.050 1~mICH RELATES TO THE PENALTY OF VIOLATION OF THE SUBDIVISION
REGULATIONS; AND ADDING A SECTION TO TITLE ONE OF THE ASHLAND MUNICIPAL
CODE TO PROVIDE FOR INFRACTIONS AND THE PENALTY FOR THE VIOLATION THEREOF.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. There is hereby added to the Ashland Municipal
Code a new Section to be numbered 1.08.020, and to read as follows:
"1.08.020 Infractions. A person who commits an infraction
by violating designated provisions of the Ashland
Municipal Code shall not suffer any disability or legal
disadvantage based upon conviction of crime. The
penalty for committing an infraction shall be a fine
not to exceed $100; however, each and every day during
any portion of which any infraction is committed,
continued or permitted by any such person, is a separate
violation subject to a separate fine of $100, and such
person shall be punished accordingly. The trial of
any infraction shall be by the Court without a jury.
The City of Ashland shall have the burden of proving
the infraction by a preponderance of the evidence and
the Defendant may not be required to be a witness in
the trial of such infraction. At any trial involving
an infraction, the City Attorney shall not appear unless
the Defendant is represented by an attorney. Further,
at any such trial, defense counsel shall not be provided
at public expense."
SECTION 2. Section 17.32.050 of the Ashland Municipal Code
is amended to read as follows:
"Any person who violates or fails to comply with any
provisions under this title is, upon conviction thereof,
subject to the penalties described in Section 1.08.020
of the Ashland Municipal Code relative to infractions."
SECTION 3. Section 18.68.100 of the Ashland Municipal Code
is hereby amended to read as follows:
"18.68.100 Penalties. Any person, firm or corporation,
whether as principal, agent, employee, or otherwise,
violating or causing the violating of any of the provisions
of this title has committed an infraction, and upon
conviction thereof is punishable as prescribed in Section
1.08.020. Such person, firm, or corporation is guilty
of a separate violation for each and every day during
any portion of which any violation of this title is
committed or continued by such person, firm or corporation."
