An ordinance amending Ordinance No. 1361, establishing and
fixing the filing fees for conditional permits, variances,
appeals and amendments to the zoning map.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1.
Section 39. Conditional Use Permits, (1) Application, shall
be, and the same is hereby amended to read as follows, to wit:
"(1) Application. The owner or his agent may make
application with the staff advisor to the Planning
Commission. Such application shall be accompanied
by a legal description of the property, plans and
elevations necessary to show the proposed development,
and a filing fee based on the following schedule, no
part of which is refundable:
R-F,R-l,R-2 zones
R-. 3 zone
C-l,C-2,C-3, M zones

(4) Appeal, shall be,
and the same is hereby amended by adding a new subsection (d) to
read as follows, to wit:
"Cd) The application for appeal shall be accompanied
by a filing fee of $10.00, which is refundable in the
event said appeal is sustained."
SECTION 3.
Section 40. Variances, (1) Application, shall be, and the same
is hereby amended to read as follows, to wit:

Also to be included with such application shall be a statement
and evidence showing:
(a) That there are exceptional or extraordinary circum-
stances or conditions applying to the land, building, or
use referred to in the application which circumstances
or conditions do not apply generally to land, buildings,
or uses in the same district.
(b) That the granting of the application is necessary
for the preservation and enjoyment of substantial prop-
erty rights of the petitioner.
(c) That the granting of such application will not,
under the circumstances of the particular case, be
outweighed by the adverse effects to the health or
safety of persons residing or working in the neigh-
borhood of the property of the applicant, and will not,
under the circumstances of the particular case, be
material detrimental to the public welfare or injur-
ious to property or improvements in said neighborhood. I!
SECTION 4.
Section 40. Variances, (4) Appeal, shall be, and the same is
hereby amended by adding a new subsection (d) to read as follows,
to wit:

event said appeal is sustained."
SECTION 5.
Section 43. Amendments, (1) Initiation of Amendments, shall be,
and the same is hereby amended by amending subsection (c) to read
as follows, to wit:
'{c) Application by one or more property owners, or their
authorized agents, of property affected by the proposed
amendment. The application shall be filed with the staff
advisor to the Planning Commission and shall be accompanied
by a legal description of the property or properties affected;
a map showing the property or properties affected within a
radius of 300 feet of the exterior boundaries thereof; and a
filing fee based upon the following schedule, no part of
which is refundable:

The foregoing ordinance was first read, and passed to second
reading at a regular meeting of the Common Council held on the
