ORDINANCE NO. 1317
An Ordinance amending Section 9 of Ordinance No. 1261, the
zoning ordinance of the City of Ashland, to provide that in Zone
No.3, Residential District, and Zone No.4, Low Density Residen-
tial District, on corner lots the street side yard shall be changed
from a minimum of 16 1/2 feet to a minimum of 10 feet, and declaring
an emergency.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
Section 1.
That. Section 9 of Ordinance No. 1261 be, and the same hereby
is, amended as follows:
"Section 9.
That set.-back lines for new building construction in
Zone No. 3 and Zone No. 4 are hereby established as a dis-
tance from the street side-line which is not less than the
average distance from said street side-line of existing
resi.dence buildings in the block facing the street on which
the proposed building is to face; provided, however, that
on new streets or streets without established set-back lines
all buildings shall be constructed at least sixteen and
one-.half (16~) feet from the street side-line, except that
on corner lots the street side yard shall be a minimum of
ten (10) feet. Any dispute as to the amou.nt of set-back
required is to be determined by the City E:ng ineer, with
the right of appeal to the City Council and Planning Com-
mission. Provided, however, that where the set-back
requirement of sixteen and one-half (16~) feet would be
impJ~actical because of the steepness of terrain, the
Planning Comm.ission, upon application, may~ waive any set-
back requirement or require a set-back of less than sixteen
and one-half (16~) feet. II

Section 2.
Due to the fa.ct that there are building applications awaiting
the passage of the~ aforementioned section, in order to prevent
further delay in such construction it is deemed necessary for the
public p~~ace, health and safety of the people ()f the City of Ashland
that an t~mergency be, and the same is hereby, declared to exist
and this ordinance shall be in full force and effect from and after
its passage by the! Council and approval by the Mayor.
The foregoingr ordinance was duly passed, under a suspension
of the rules, at a. regular meeting of the Common Council held on
the //~:'-.7/~ay of ~, 1962, the vote being as follows:
