AN ORDINANCE ORGANIZING AND CREATING THE ADMINISTF~TIVE AND OPERATING
DEPAR1MENTS OF THE CITY OF ASHLAND; REPEALING ORDINANCE NUMBER 1315
ALL OTHER ORDINANCES OR RESOLUTIONS IN CONFLICT HEREWITH; AND DECLAR-
ING AN EMERGENCY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ASHL1~ND:
CHAPTER I CITY ADMINISTRATOR DEPARTMENT
/ SECTION 1.01. A City Administrator Department is hereby created
which shall be under the direct control and management of the City
Administrator, and shall consist of the City Administrator, the
employees provided for by the Position Classification Plan or a
Position Ordinance, and such other employees as the City Administrator
may assign to said Department.
d- SECTION 1.02. The City Administrator shall have i:he duties, respon-
sibilities, authorities and jurisdictions provided by the Charter of
the City of Ashland, the Ordinances and Resolutions adopted by the
Council, and the laws of the State of Oregon~ wherein they relate
to the administration of the City. With City Council acknowledgement,
the City Administrator is hereby empowered to make such rules and
regulations for the conduct of the various administrative departments
of the City as he may deem necessary from time to time.
SECTION 1.03. The City Administrator shall have responsibility for the
general administrative coordination of all city departments, and,
excepting those officers and employees of the Park Department, Commun-
ity Hospital, and Public Library under the control of Administrative
Boards and Commissions which are either separately elected or appointed
by the Mayor with confirmation by the City Council, the City Adminis-
trator shall have the right to submit recommendations as to the apppoint-
ment or dismissal of all principal officers and department heads by
the Mayor and confirmed by the City Council. The Mayor and City Coun-
cil, the City Administrator, or the appropriate department head may
directly appoint or dismiss all subordinate employees.
~ SECTION .1.04. In addition to general City-wide administrative duties
and responsibilities, the City Administrator shall also be considered
ex-officio Personnel Officer and ex-officio Planning Officer for the
City of Ashland. In the former capacity he shall insure the proper
operation of a modern personnel merit system for the City Service con-
sistent with applicable Ordinances and Resolutions by advising depart-
ments on personnel problems, administering the classification and
salary plans, recruiting personnel, conducting employee relations,
assisting in organizing studies and manpower control, maintaining
an employee roster, and related personnel records necessary to facili-
tate and control personnel actions, and furnishing the City Council
with such personnelmformation as it may require. In the latter
capacity, he shall render staff work and professional and technical
advice affecting the development of the City, and to assist, or by
his designated representative, the Planning Commission in the dis-
charge of its duties and responsibilities.

CHAPTER II. CEMETERY DEPARTMENT
SECTION 2.01. A Cemetery Department is hereby created which shall be
under the direction of the Cemetery Superintendent, and shall consist
of such employees authorized by the Position Classification Plan or a
Position Ordinance, and such other employees as the City Administrator
might assign to said Department.

SECTION 2.02. The functions of the Cemetery Department are the sale
of other disposition of places of burial under control of the Ashland
Cemetery, the maintenance and care of all cemetery grounds, equipment,
mausoleums, and structures, the preparation of accurate records of
all burials, cemetery expenditures and revenues, and the maintenance
of a perpetual inventory.
CHAPTER III. ELECTRIC UTILITIES DEPARTMENT
? SECTION 3.01. An Electric utilities Department is hereby created which
shall be under the direction of the Director of Electric Utilities,
and shall consist of such employees authorized by the Position Classi-
fication Plan or a Position Ordinance, and such o1:her employees as
the City Administrator may assign to said DepartmE:mt.

SECTION 3.02. The Director of Electric Utilities, subject to the
approva~ of the City Administrator and City Council, shall organize
and maintain such divisions in said Department as the operation may in
his judgement require. The Director of Electric Utilities shall be
responsible for the general supervision and control of all Divisions
of said Department and for the performance of the functions herein
assigned to said Department.

SECTION 3.03. The functions of the Electric utilities Department are
the efficient construction, operation, and maintenance of the electric
distribution system; the installation of all new lines, services, and
meters; the maintenance of the generation plant; -the preparation of
accounting records, electric revenue and expenditures, and perpetual
inventories; the preparation and submission of proposed work programs
including estimates of cost; the construction, installation, and main-
tenance of all electric traffic control devices where appropriate;
the installation, maintenance, and operation of the City radio communi-
cations system; and the installation, maintenance, and operation of all
other electrical equipment and facilities of the City.
CHAPTER IV. FINANCE DEPARTMENT

SECTION 4.01. A Finance Department is hereby created which shall be
under the direction of the Director of Finance, and shall consist
of such employees authorized by the Position Classification Plan or a
Position Ordinance, and such other employees as the City Administrator
may assign to said Department.

SECTION 4.02. The Director of Finance, subject to the approval of the
City Administrator and City Council, shall organize and maintain such

divisions in said Department as the operation may in his judgement
require. The Director of Finance shall be responsible for the general
supervision and control of all Divisions of said Department and for the
performance of the functions herein assigned to said Department.
l;r SECTION 4.03. The functions of the Finance Depart:ment are the ad-
ministration and collection of various City taxes., licenses, and per-
mi ts and the administration of ordinances and Stat:e Laws applicable
thereto; the receipt and safe keeping of all City money; preparation
and control of the City Budget; procurement of mat.erials, supplies,
equipment and services; the reproduction of forms " records and other
printed material; receipt, storage and issuance of supplies, materials
and equipment; the disposal of surplus property~ fisca~ and property
accounting; records management and data processinq; financial esti-
mating, planning and programming~ billing and coLlecting~ administra-
tion and operation of public off-street parking facilities; operation
and maintenance of parking meters~ keeping of minutes of the City
Council; recordation of ordinances, resolutions and various assessment
proceedings; the general maintenance and repair of all public build-
ings belonging to the City and located within the City limits and such
other public properties belonging to the City as Inay be designated by
the City Administrator; the cleaning, maintenance and repair of the
City Hall, and all other publ~c buildings belonging to the City which
are in the City Hall area and used for general administrative purposes;
supervision and control of the City Warehouse and Yard; the repair and
maintenance of all motor equipment of the City, except Fire Department
motor equipment; establishing and operating a cen'tralized shop and
warehouse; the performance of all duties prescribed by the Charter and
ordinances of the City of Ashland and the laws of the State of Oregon
for those officers and officials included in the Finance Department;
and the performance of such other functions as may l:e assigned by the
City Administrator or prescribed by the City Council.
CHAPTER V. FIRE DEPARTMENT
SECTION 5.01. A Fire Department is hereby created which shall be under
the direction of the Fire Chief, and shall consist f such employees
provided for by the Position Classification Plan or a Postion Ordinance,
and such other employees as the City Administrator may assign to said
Department.

SECTION 5.02. The Fire Chief, subject to the approval of the City ",/
Administrator and City Council, shall organize and maintain such div-
isions in said Department as the operations may in his judgment re-
quire. The Fire Chief shall be responsible for the supervision and
control of all. divisions of said Department and for the performance
of the functions herein assigned to said Department. The Fire Chief
shall have control and management of all officers, members, equipment,
and functions of the Fire Department. The Fire Chief shall have authority
to adopt rules and regulations for the administration, discipline, equip-
ment and uniforms of members and officers of the Department, fixin~;the
powers and duties and prescribing penalties for violations of any such

rules an~ regulations and providing for their enforcement.
IS' SECTION 5.03. The functions of the Fire Department are the prevention
and extinguishment of fires; the enforcement of all laws and ordinances
relating to the prevention and extinguishment of fires and the storage,
sale, and use of oils, combustible materials and explosives; the inves-
tigation of the causes of all fires and the reporting of the same to the
Police Department in all cases where there is reason to believe that
any fire is the result of crime or that crime has been committed in
connection therewith; the inspection of all hydrants, stand pipes, and
other water supply systems; the performance of disaster and mutual aid
services in accordance with approved plans or agreements: the perfor-
mance of such other functions as may be assigned by the City Administra-
tor or prescribed by ordinance of the City Councilor by applicable
State Law.
{& SECTION 5.04. In addition to the performance of their regular and
ordinary duties it shall be the duty of all members of the Fire Depart-
ment at all times and under all circumstances to (~o to the aid of all
persons or animals in distress or danger and render them such help and
assistance as lies within their power and to perform any and a~l other
duties when ordered by the Fire Chief. In case any member of the Fire
Department is injured while rendering such additional services he shall
be deemed to be injured in the course of his employment.

CHAPTER VI. JUSTICE DEPARTMENT
SECTION 6.01. A Justice Department is hereby created which shall be
under the direction of the Municipal Judge, and shall consist of such
employees provided for by the Position Classification Plan or a Position
Ordinance, and such other employees as the City Administrator may assign
to said Department.
SECTION 6.02. The Municipal Judge shall be the judicial officer for
the City of Ashland and shall sit in police court judgment for mis-
demeanor cases involving violations of all City ordinances, of the City
Charter, of the Oregon Revised Statutes Traffic Act, and of the Oregon
Juvenile Court, coordinating, advising, and hearing recommendations
from a Juvenile Jury. The Municipal Judge advises and acts as consul-
tant to the Police Department, may punish defendants found guilty of
violations by prescribed fine or imprisonment, or both: he may suspend
or dismiss, for cause, any case or fine or prison sentence; he may issue
warrants for non-appearance in court or failure to carry out sentences
imposed.
/1 SECTION 6.03. Whenever, in the opinion of the ~unicipal Judge, the
City Administrator, or the City Council, the interests of the City re-
quire it, a substitute Municipal Judge may be employed at the expense
of the City upon such terms as are prescribed by the Councilor City
Administrator.

dO SECTION 6.04. The Municipal Judge shall keep on file in his office
all written communications and opinions, decisions, briefs and papers
used in cases wherein he presides. The Municipal Judge shall deliver
all books, records, papers, documents and property of every description
belonging to the City to his successor in office.
CHAPTER VII. LEGAL DEPARTMENT
~l SECTION 7.01. A Legal Department is hereby created which shall be
under the direction of the City Attorney, and shall consist of such
employees provided for by the Position Classification Plan or a Posi-
tion Ordinance, and such other employees as the City Administrator
may assign to said Department.
(Yd SECTION 7.02. The City Attorney shall be the Chief Administrative
Officer of the Legal Department, and shall prosecute and defend for the
City of Ashland all actions at law or in equity, and all special pro-
ceedings for or against the City of Ashland. The City Attorney shall
commence any legal proceedings when directed to do so by the City Ad-
ministrator or City Council, and he shall give legal advice in writing
to the Mayor, the Council, the City Administrator, chief officials,
and Boards and Commissions when requested to do so by them, upon
questions Of law arising in their separate departments involving the
rights and li~bilitie. of the City. The City Attorney shall not settle
or dismiss any litigation for or against the City, or take an appeal
to any appellate court unless he is instructed to do so by the City
Council.
;) 3 SECTION 7.03. The City Attorney shall draw such ordinances, resolu-
tions and contracts, or other instruments, as shall be requested by
the Councilor the City Administrator, shall attend the meetings of the
Council when requested to do so by the Mayor or members of the Council,
or the City Administrator.
cJ4 SECTION 7.04. Whenever, in the opinion of the City Attorney, the City
Administrator, or the City Council, the interests of the City require
it, assistant or substitute counsel may be employed at the expense of
the City, upon such terms as are prescribed by the Councilor City
Administrator.

SECTION 7.05. The City Attorney shall keep on file in his office all
written communications and opinions, briefs and papers used in cases
wherein he appears. The City Attorney shall deliver all books, records,
papers, documents and property of every description belonging to the
City to his successor in office.
dL SECTION 7.06. The City Attorney shall be ex-officio Prosecuting
Attorney and as such shall prosecute all criminal violations of the
provisions of the Charter or any City Ordinance.
CHAPTER VIII. POLICE DEPARTMENT
017 SECTION 8.01. A Police Department is hereby created which shall be un-
der the direction of the Chief of Police, and shall consist of such

employees provided for by the Position Classification Plan or a Posi-
tion Ordinance, and such other employees as the City Administrator
may assign to said Department.
c3g SECTION 8.02. The Chief of Police shall organize and maintain such
divisions in said Department as the operations may in his jUdgment
require, and shall be responsible for the supervision and control of
all divisions of said Department and for performance of the functions
herein assigned to said Department. The Chief of Police shall, in the
lawful exercise of his duties, and subject to the provisions of the
City Charter, have all the powers that are now or hereafter may be con-
ferred upon sheriffs by the laws of the State of Oregon, and shall be
entitled to the same protection.
~0 SECTION 8.03. The Chief of Police shall have authority to adopt rules
and regulations for the administration, discipline, equipment and uni-
forms of the members and officers of the Department, fixing powers and
duties and prescribing penalties for violations of any such rules and
regulations, and providing for their enforcement.
JD SECTION 8.04. The functions of the Police Department are the mainten-
ance of law and order in the City~ the enforcement in the City of all
laws of the United States and of the State of Oregon, and all ordin-
ances of the City, except when such enforcement is by such law, ordin-
ance or the Charter of the City made the responsibility of another
ofEicer or department, or when such enforcement is the responsibility
of a State or Federal Agency or officer; the administration of the City
prisoh and the care, custody and control of prisoners; the operation
of the City pound; the performance of such other functions as may be
assigned by the City Administrator or prescribed by ordinance of the
Councilor by applicable State law.
CHAPTER IX. PUBLIC WORKS DEPARTMENT

SECTION 9.01. A Public Works Department is hereby created which shall
be under the direction of the Director of Public Works, and shall
consist of such employees provided for by the Position Classification
Plan or a Position Ordinance, and such other employees as may be
assigned by the City Administrator to said Department.
SECTION 9.02. The Director of Public Works, subject to the approval
of the City Administrator, shall organize and maintain such divisions
in said Department as the operations may in his judgment require, and
shall be responsible for the supervision and control of all divisions
of said Department and for the functions herein assigned to said De-
partment. The Direotor of Public Works shall be ex-officio City
Engineer, ex-officio Street Commissioner, and ex-officio Water
Superintendent.
SECTION 9.03. The functions of the Public Works Department are the
construction and maintenance of all streets, alleys, paths, rights-
of-way, and courts now open or which hereafter may be opened; the
cleaning of streets; the construction, maintenance" and operation of
the sewer and storm drain systems; the maintenance and operation of

the sewage disposal plant; the construction, maintenance, and operation
of the water distribution system; the maintenance and operation of the
water filtration and power plant; the supervision of all work done
on streets, alleys or other public ways, lands, buildings, or other
structures by anyone other than the City of Ashland; the enforcement of
all laws, ordinances and regulations governing the erection and occu-
pancy of buildings and structures, and the alterations of or additions
to buildings and structures; the performance of traffic engineering;
the performance of all phases of engineering work required in connection
with all the functions of said department; the keeping of records of
all surveys and measurements made, which records shall be open for
public inspection. .
CHAPTER X. GENERAL PROVISIONS

SECTION 10.01. This Ordinance shall be known as "The Organization
Ordinance", and shall be referred to as such.
3S- SECTION 10.02. The officers and employees of the foregoing Divisions
and Departments shall perform such other duties as may be required of
them by the City Charter, laws or ordinances of the City of AShland,
and such other or further duties as may be required from time to time
by the person having direct charge of the Division or Department, or
by the City Administrator, or by the City Council.
-3" SECTION 10.03. Inasmuch as the City of Ashland has not formally
adopted an Organization Ordinance, it is deemed necessary for the peace,
health and safety of the citizens of Ashland that an emergency be, and
the same is hereby declared to exist and this ordinance shall be in full
force and effect from and after its passage by the Common Council of the
City of Ashland and approval by the Mayor.
CHAPTER XI. LEGAL REQUIREMENTS.

SECTION 11.01. Ordinance Number 1315 and all or parts of ordinances
amendatory thereof or in conflict herewith are hereby repealed.
The foregoing ordinance was duly passed, under a suspension of
rules, ~ular meeting of the Common Council held on i:he
