Draft: For Committee consideration:
I] Sections of the current Ashland City Charter to be removed or rewritten:
Article I, Section 3. Boundaries: "The Recorder shall keep…..hours of the Recorder" -
remove - this is covered by state law.
Article III, Section 3. Salaries: remove, as committee voted to remove all salary
language.
Article III, Section 6. Interest in City Contracts - remove; covered by ORS 244.
Article IV, Mayor, Section 2. add mayoral duties as reflected in Hal's memo of 6/15.
Article IV, Mayor, Section 3 modify to reflect decisions of committee.
Article VI, Recorder, Section 2 - remove - unnecessary; stated in Municipal Code
2.08.020.
Article VII, Elections Section 2 & 3 - remove, superceded by ORS 254
Section 5 - change to an ordinance
Section 6 - remove - ORS 254
Section 7 - remove - ORS 254.575
Article VIII, Council, Section 2 - rewrite, reflecting committee's vote
Sections 5 & 6 - remove - ORS 192
Article IX , Special Powers of the Council,- remove all.
Article XI, Public Improvements, Sections 1 & 4 - remove - ORS 279
Article XII, Taxation - remove all - ORS 294 and 310
Article XIII, Appointive Officers, Section 4 - remove, ORS 244
Article XIV, Chief of Police - remove all; this is inherent in city structure. Section 2 could
be rewritten as an ordinance.
Article XV, Court, Section 2 - remove last sentence; this has never been done
Section 3 - remove, superceded by ORS 138
Section 4 - remove.
Article XVI, Miscellaneous Provisions, Section 1, keep and rewrite.
Section 2 - remove
Section 3 - "No suit, action….and made valid in every particular." remove,
ORS 30.
Section 4 - remove.
Article XVII, Hospital - remove and create Ordinance.
Article XVIII, Cemeteries Trust Fund - remove and create Ordinance. This would
maintain flexibility to be able to respond to changes in state law.
Article XIX, Park Commission, Section 3 - remove - to reflect committee's vote to take
funding language out of the charter
Article XX, Municipal Airport - remove to Ordinance.
Article XXI, City Band - rewrite, removing funding language.
Article XXII, Recreation Commission - add to Article XIX, Parks
2] As we have voted to use the Model Charter as our starting point, these items
unique to Ashland may be added to the Model Charter:
Article III, Elective Officers - include Recorder and Municipal Judge.
Article XVI, Misc. Provision, Section 1, Public Utilities - Water works, as rewritten
Article XIXa, Open Space Park Program
Article XXI, City Band, as rewritten.
Article XXII, Recreation
Periodic Review, added at the end of document.
Mayoral Powers, per Cloer memo.
All issues which the committee has studied and voted on.
