A s the owners of the property listed above, we hereby consent to the following requirement established by the City of
Ashland at the planning action meeting held on January 28, 1997. This agreement is to be binding upon ourselves, our
heirs, executors, and assigns, and it is our express intention that this Agreement shall run with the land so that
fulfillment of the items listed below shall be binding upon future owners of the property. This consent is in consideration
of approval by the City of Ashland of our request to modify the building envelope, moving it from the north side of Roca
Creek to the south side of Roca Creek.
Owners agree that no permanent road shall be constructed over Roca Creek in order to provide automobile access to or
parking by the house site on the south side of Roca Creek. The owners may, however, construct a temporary road to be
used during construction of their residence with the provision that this temporary road shall be removed and the creek
restored to its natural condition upon completion of construction.
