FINDINGS OF FACT BY THE CITY COUNCIL
PLANNING ACTION NO. 80-83
In reviewing the data and testimony which are in the record of Planning
Action #80-83 from the Planning Commission, and additional data and
testimony presented at the public hearing held on January 20, 1981 before
the City Council, we make the following conclusionary findings:
1) That subject property is designated as Retail Commercial
in the City's Comprehensive Plan.
2) That the property was zoned as R-2, as a result of a draft-
ing error made in the City's Zoning Map which was adopted
on February 8, 1980.
3) That the property already has two commercial establishments
on it, and is committed to commercial uses.
4) That the property is better suited for commercial uses than
residential uses.
The foregoing findings of fact and conclusions were ADOPTED at a regular
meeting of the City Council on the 3rd day of February, 1981 and SIGNED
this~day of February, 1981.

On November 12, 1980, the Ashland Planning Commission unanimously voted to
recommend to the City Council that Planning Action #80-83 be approved. The
request was also unanimously approved by CPAC at its November 11, 1980 meeting.
Included with this memo are the Staff Report, minutes, and findings associated
with Planning Action 80-83.

APPLICANT: City of Ashland
LOCATION: North side of Lithia Way between 2nd Street and 3rd Street and south of
"C" Street.
ZONE DESIGNATION: R-2
ORDINANCE REFERENCE: 18,108, 18.24, 18.32
COMPREHENSIVE PLAN DESIGNATION: Retail Commercial
TYPE OF ACTION: Change of Zone from R-2 to C-1
REQUEST:
I. RELEVANT FACTS
1) This property was incorrectly designated as R-2 when the new zoning map
became effective on February 8, 1980. The property was designated as
Retail Commercial in the City's Comprehensive Plan adopted in April 1978.
2) Description of the Site - The property is flat and has no unusual topographic
features. The property is the location of Ivan's Car Repair Business, Van
Vleet Real Estate and one single-family residence.
3) Surrounding Area and Land Use - Property to the south and west is commercial
use, property to the north and east is in residential use.
4) -Detailed Description of the Proposal - This request is to change the zoning
from R-2 to C-1 to correct a drafting error made in the zoning map adopted
in February of 1980. It involves four tax lots located on the triangular
piece between Lithia Way, "C" Street, and Third Street.
II. PROCEDURAL
The following findings are reasons for this request:
1) The entire property is designated as Retail Commercial in the City's Compre-
hensive Plan.
2) There was a mistake made in the d~afting of the City's zoning map which became
effective on February 8, 1980.
3) The property already has two commercial establishments on it.
4) The property is better suited for C-1 (Retail Commercial) zoning than for
R-2 (Low Density Multiple-family Residential) zoning.
III. RECOMMENDED ACTION
Staff would recommend that the property be rezoned from R-2 to C-1.

DESCRIPTION: Planning Action #80-83 is a request for
a Zone Change from R-2 (Low-Density Multiple-Family
Residential) to C-l (Retail Commercial) for property
locathd on the north side of Lithia Way between Second
Street and Third Street and .south of "C" Street. This
change is necessary to correct a drafting error made in the
newly adopted zoning map of the City. Zoning: R-2 (Low-
Density Hultiple-Family Residential). Comprehensive Plan
designation: Retail Commercial. Assessor's map #: 9BD.
Tax lots: 1800, 1801, 2100 and 2200.
APPLICANT: City of Ashland.
STAFF REPORT: Wanderscheid gave the staff report. He
stated that this was mainly a drafting error that was
being corrected by staff.
PUBLIC HEARING:
There was no one to speak for or against this request, so
the public hearing was closed.
COMMISSION DISCUSSION AND MOTION:
1. Billings moved to approve'PA#80~83 with staff findings
and no conditions. The motion was seconded by Apenes and
passed unanimously.
