~ubjttt: Agreement for Street Improvement Assessments
Two property owners on Granite Street are interested in
entering into an agreement whereby, for certain considera-
tions, one would assume street improvement assessments on
the other's property.
The City of Ashland would be a party to this agreement
since it would be levying the assessment.
Would you please forward the agreement to the Council for
its consideration? It will have to authorize the Mayor
and Recorder to sign for the City.
Ron Salter prepared the agreement and will answer questions
concerning it.

AGREEMENT CONCERNING ASSESSMENTS
lie, James B. Smay and Betty F. Smay
husband and wi fe, as the owners of a tract or parcel of land situated in the
Northeast quarter of Section 17, Township 39 South, Range 1 East of the Wi11amette
Meridian, Jackson County, Oregon, and being described by instrument no. 76-11418 of
Jackson County Deed Recqrds and excepting therefrom that parcel described by instrumen~
no. 78-06676 of said de~d teCOfds .
do consent to the toliOWlng described lmprovement:
Improvement of Granite Street with curb, gutter and paving from the present end of
pavement to a point approximately 880 feet southerly.
Said consent is on the basis that neither we nor our property
'will be assessed or compelled to pay anything for said improvement.

We, Mark K. Cooper and Linda L. Cooper
husband and wife, being the owners of a tract or parcel of land situated in the
Northeast quarter of Section 17, Township 39 South, Range 1 East of the Wi11amette Meridian,
Jackson County, Oregon, and being described as parcel nos. 2, 3 and 4 as recorded in
instrument no. 79-00427 of Jackson County Deed Records and excepting therefrom that parcel
described by instrument no. 78-20940 of said deed records
do recognize that our property will be substantially and particularly
benefited by the above described improvement and that in order for said
improvement to be~installed, and to avoid remonstrances that might
prevent the improvement from being installed, we agree, for ourselves,
our successors and assigns, that our property and ourselves shall be
liable for the assessment to be assessed against the property described
in the first paragraph of this Agreement as well as for the assessment
against our own property. In other words, so that this improvement
project may be approved, we for ourselves, our successors and assigns,
and so that this obligation will run with the land, do agree that our
property shall be assessed the amount that would normally be assessed
against the above described property as well as the amount that would

The City of Ashland hereby acknowledges the above Agreement
and agrees to not assess the property owned by the Smays, but to levy
upon the property owned by the Coopers, that assessment which would
have been ~ssessed against the Smay property_
