Collection Agreement
between
Rogue River National Forest
and
The City of Ashland
THIS COLLECTION AGREEMENT, is hereby made and entered into by and between City
of Ashland hereinafter referred to as the Cooperator and the Rogue River
National Forest, U.S. Department of Agriculture Forest Service, hereinafter
referred to as the Forest Service, under the provisions of the
Intergovernmental Cooperation Act of 1968, Title III (P.L. 90-577).
I. INTRODUCTION
The Forest Service and the Cooperator have established this agreement to help
one another accomplish the mutually beneficial objective of locating rare plant
populations where they may occur on Cooperator's land, so that this information
may be used in the design of mutually beneficial projects as described below.
II. MUTUAL BENEFITS
Both the Forest Service and the Cooperator own and manage lands in the Ashland
Creek Watershed. The watershed is managed by both parties as the source of
Ashland's water supply. Natural fuels buildup in the watershed makes the
potential for wildfires high and control difficult. Both parties have
undertaken fuels reduction projects and construction of fue1breaks in strategic
parts of the watershed. Both parties are currently planning further fuels
reduction and forest canopy density management projects as well as maintenance
of existing fuel breaks. The efforts of both parties mutually enhance the
effectiveness of efforts done by the other party.
Forest Service policy is to know the environmental effects of proposed actions
and, when feasible, to maintain or enhance the viability of rare plant
populations. The Cooperator wishes to have the same knowledge of environmental
effects, and to have information about rare plant populations on their land in
order to plan and implement their wildfire prevention projects in an
environmentally responsible manner. The Forest Service believes knowledge of
rare plant populations on Cooperator's land will allow more effective
management of the viability of rare plant populations in the watershed as a
whole.
III. THE FOREST SERVICE SHALL:
1. Bill the Cooperator prior to commencement of work for deposits
sufficient to cover the estimated costs, including overhead, for the specific
payment period. Billings shall be sent to: Keith Woodley, Chief, City of
Ashland Fire Dept., 455 Siskiyou Blvd., Ashland, OR 97520.
2. Use these funds only for the purpose of performing the work necessary
and related to the rare plant survey project as agreed upon.
3. To refund to the Cooperator any cash balance contributed which is not
required by the Forest Service for the purposes of this agreement.

4. Be responsible for the supervision and the standards of workmanship for
the rare plant survey project.
5. Support the project by re-arranging earlier Forest Service personnel
work schedules in order to accomplish the work.
6. Provide 1. Forest Service Botanist, and possibly assistants, to do the
rare plant survey, 2. a written report and map with findings and management
recommendations, and 3. all transportation, supplies, etc. necessary to
accomplish the survey.
IV. THE COOPERATOR SHALL:
1. Meet with the Forest Service to agree upon the specific work to be
done.
2. Upon presentation of a Bill for Collection, deposit with the Rogue
River National Forest, prior to the beginning of work, an agreed upon amount of
$1540. This amount shall be expended by the Forest Service to pay for those
agreed upon costs.
V. IT IS MUTUALLY AGREED AND UNDERSTOOD BY AND BETWEEN SAID PARTIES THAT:
1. Modifications within the scope of the instrument shall be made by
mutual consent of the parties, by the issuance of a written modification,
signed and dated by both parties, prior to any changes being performed. The
Forest Service is not obligated to fund any changes not properly approved in
advance.
2. Give the Forest Service or the Comptroller General, through any
authorized representative, access to and the right to examine all books,
papers, or documents related to this instrument.
3. Improvements placed on National Forest System land, at the direction of
either of the parties, shall thereupon become the property of the United
States, and shall be subject to the same regulations and administration of the
Forest Service as other National Forest improvements of a similar nature.
4. This instrument in no way restricts the Forest Service or the
Cooperator(s) from participating in similar activities with other public or
private agencies, organizations, and individuals.
5. No part of this instrument shall entitle the Cooperator to any share or
interest in the project, other than the right to use and enjoy the same under
the existing regulations of the Forest Service.
6. Pursuant to Section 22, Title 41, United States Code, no Member of, or
Delegate to, Congress shall be admitted to any share or part of this
instrument, or any benefits that may arise therefrom.
7. This instrument is executed as of the last date shown below, and
expires no later than Sept. 30, 1997 , at
which time it is subject to review, renewal, or expiration.

9. Contributions authorized for use by the Forest Service, which are not
spent or obligated for the project approved under this instrument, will be
refunded to the Cooperator or authorized for use for new projects, as agreed
with by the Cooperator.
10. Either party(s) upon mutual agreement, in writing, may terminate the
instrument in whole, or in part, at any time before the date of expiration.
The Forest Service shall not incur any new obligations for the terminated
portion of the instrument after the effective date, and shall cancel as many
obligations as is possible. Full credit shall be allowed for Forest Service
expenses and all noncancellable obligations properly incurred up to the
effective date of termination. Excess funds shall be refunded within 60 days
after the effective date of termination.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the
last date written below.
