NOTICE OF CITY MEASURE ELECTION
CITY OF ASHLAND
JACKSON COUNTY, OREGON
NOTICE IS HEREBY GIVEN that on Tuesday, November 7, 2006 a Measure Election will be
held in the City of Ashland, Jackson County, Oregon.
The election will be conducted by mail.
A special election is called to be held in the City of Ashland, Oregon, on November 7, 2006, at
which election there is to be referred to the voters for their adoption or rejection the following
proposed measure:
CAPTION:
"AMENDS MUNICIPAL CHARTER REQUIRING VOTER
APPROVAL OF A PROPERTY TRANSFER TAX".
QUESTION:
"Shall Article 12, Section 4, be added to the Ashland City Charter
requiring voter approval of any property transfer tax?"
EXPLANATION:
"Currently state statute prohibits local governments, including cities, from
enacting and assessing any tax on the transfer of real property. If the state
laws were amended to allow the enactment of real property taxes, it may
be possible for the city to enact a real property transfer tax without
submitting the tax to the voters of Ashland. Passage of this measure
would amend the city's charter to require voter approval before any real
property transfer tax could be enacted in Ashland."

which includes completion of the ballot title challenge process.

Statement:
A qualified initiated measure for the November 2006 ballot was received by the City Recorder's
Office on May 24, 2006 and as is required, has been filed with the city governing body no later
than the next meeting of the council.
Background:
An initiative petition process to amend the City Charter "Requiring Voter Approval of a Property
Transfer Tax" began on March 17,2005.
As the City Elections Officer, the City Recorder verified that the proposed charter amendment
complied with the procedural constitutional requirements and forwarded the prospective
initiative petition to the City Attorney's Office. The City Attorney prepared the ballot title and
the City Recorder proceeded with the noticing requirements.
The Chief Petitioners were notified by the City Recorder that they had met the requirements for
circulating a petition on April 7, 2005.
On May 24, 2006 the required number of signatures was submitted to the City Recorder for the
review by City Council. Our City Municipal Code states that the required number of signatures
for an initiative is 15% of the total number of votes cast in the last Mayoral election, which
amounted to 1,582. The number of signatures verified for the initiated measure was 1,601.
As required by City Code, a deposit in the amount of $200 has been received.
Council Options:
State requires that this be submitted to city electors at the next available election date which is no
sooner than the 90th day after the completed initiative petition was filed with the city governing
body. The next available election date is November 7, 2006.
The Council may also refer a competing measure to the ballot at the same election where the
initiated measure will appear. If the council chooses to refer a competing measure, the measure
must be prepared no later than the 30th day after the initiated measure is filed with the city
council. This date would be no later than July 6, 2006.

INSTRUCTIONS FOR CIRCULATORS
Only active registered voters of the county, city or district may sign a petition.
All signers on anyone signature sheet must be active registered voters of the same county.
It is advisable to have signers use a pen for signing petitions or for certifying petitions.
Only one circulator may collect signatures on anyone sheet of a petition.
Each circulator must personally witness all signatures the circulator collects.
Circulators shall not cause to be circulated a petition knowing it to contain a false signature.
Circulators shall not knowingly make any false statement to any person who signs it or requests information about it.
Circulators shall not attempt to obtain the signature of a person knowing that the person signing the petition is not qualified to sign it.
Circulators shall not offer money or any thing of value to another person to sign or not sign a petition.
Circulators shall not sell or offer to sell signature sheets.
Circulators shall not accept compensation to circulate a petition that is based on the number of signatures obtained.
Warning: Violations of the circulator requirements may result in conviction of a felony with a fine of up to $100,000 and/ or prison for
up to five years.
INSTRUCTIONS FOR SIGNERS
Only active registered voters of the county, city or district may sign a petition. Sign your full name, as you did when you registered to
vote.
Please fill in the date on which you signed the petition, your printed name and your residence address in the spaces provided.
It is advisable to use a pen for signing petitions.
It is unlawful to sign any person's name other than your own. Do not sign another person's name under any circumstances.
It is unlawful to sign a petition more than once.
It is unlawful for a person to knowingly sign a petition when the person is not qualified to sign it.

NOTICE IS HEREBY GIVEN that a ballot title meeting the requirements of section
1(2)(d), Article IV of the Oregon Constitution (one subject) has been fded with the City
Recorder.
The ballot title has been prepared by the City Attorney and is as follows:
CAPTION:
"AMENDS MUNICIPAL CHARTER REQUIRING VOTER
APPROVAL OF A PROPERTY TRANSFER TAX".
QUESTION:
"Shall Article 12, Section 4, be added to the Ashland City Charter requiring
voter approval of any property transfer tax?"
EXPLANATION:
"Currently state statute prohibits local governments, including cities, from
enacting and assessing any tax on the transfer of real property. If the state
laws were amended to allow the enactment of real property taxes, it may be

ANY ELECTOR DISSATISFIED WITH THE BALLOT TITLE may petition the Circuit Court
seeking a different title and stating the reasons the title filed is insufficient, not concise or unfair.
Petition must name as respondent the City Attorney and must be filed no later than the 7th day
after ballot title is filed with the City Recorder, March 28, 2005. The court shall review the title
and measure to be initiated or referred, hear arguments, if any, and certify to the city elections
officer a title for the measure which meets the requirements ofORS 250.035.
AN ELECTOR FILING A PETITION shall notify the city elections officer in writing that the
petition has been filed. The notice shall be given NO LATER THAN 5 p.m. on the next business
day following the day the petition is filed. ORS 250.296 92.

I received in my office on March 17,2005 a Prospective Petition for a Local Measure. After reviewing
the initiative, I fmd that the text of the proposed charter amendment complies with the procedural
constitutional requirements.
I am forwarding to you two copies of the prospective initiative petition for preparation of the ballot title.
Oregon law requires that the City Attorney has five business days to prepare a ballot title and file it with
the city elections official.
The ballot title is required to contain the following elements:
* A caption not to exceed 10 words. The caption must reasonably identify the subject of the initiative;
* A question not to exceed 20 words. The question must plainly phrase the chief purpose of the
initiative so that an affirmative response corresponds to a yes vote on the measure; and
* A summary of the prospective initiative not to exceed 175 words. The summary shall be concise and
impartial and summarize the measure and its major effect.

Weare requesting a Ballot Title for an Initiative Petition to add a
Section 4 to Article 12 of the Ashland City Charter as follows:
Section 4. Property Transfer Tax.

Explantiqn: Currently the City Council can ilnpose a
property Transfer Tax or fee by Ordinance. Twice
since 1980 the voters of Ashland have overwhehn-
ingly voted down this Tax. This addition to Charter
will insure that the Voters will have a vote on this
type of tax if it is ever proposed again.

Filing a New Committee: This form, along with the Campaign Account Information form (SEL 223), must be completed
and filed within 3 business days offirst receiving a contribution or making an expenditure. The "Original" box should
be marked on both forms. A date stamped copy of this form, which includes the committee's identification number, will be

Committee Directors: All political action committees must designate at least one committee director who is not the
treasurer. The treasurer may be a committee director ifthe treasurer meets the definition of "committee director" in
ORS 260.005(2). but the treasurer may not be the only committee director. If a committee has more than five directors,
attach a list of additional directors and include all the information required on the form for each director.
Amending Information on this Form: Any change in the information on this form must be filed within 10 days of
the change. To notify the filing officer of a change in information, submit this form, completed in its entirety, and mark the
"Amendment" box. An amended SEL 223 should not be filed unless the information on that form also changes.
Discontinuing: A final contribution and expenditure report that shows a zero balance must be filed, along with a
completed SEL 221 with the "Discontinuation" box marked. The final report may be filed at any time.
