required by the City of Ashland, and agree to bear the proportionate payment of associated costs. This Agreement is
to be binding upon myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that
this Agreement shall run with the land, so that fulfillment of the items listed below shall be binding upon future owners
of the property.
Action: The owner shall not install kitchen facilities into the shop/garage or studi%ffice space. The existing
property contains only one single family residence and the new shop/garage/office/studio will not be
utilized as a separate residential unit. A separate, second residential unit is not permitted without
obtaining a conditional use permit approval, and therefore use of the space as a separate dwelling would
be a violation of the hland MuniCipal Code and subject to all penalties thereof.

WARRANTY DEED

KRISTINE J. MADONIA,* hereinafter referred to as
"Grantor", conveys and warrants unto LESTER D. ADDISON and
TERESA S. KALLA, husband and wife, all that real property
situated in Jackson County, State of Oregon and described as:
Lot Eleven (11) in Block Seven (7) in QUIET VILLAGE
UNIT NO. 3 to the City of Ashland, Jackson County,
Oregon, according to the official plat thereof, now
of record.
Grantor hereby covenants that Grantor is the owner of the
above-described property free of all encumbrances except:
1. The effect of said property, or any part thereof,
lying within the Talent Irrigation District, and subject to all
water and irrigation rights, easements for ditches and canals,
and all regulations of said District, including any and all
assessments, liens and charges assessed, and to be assessed.
2. Declaration of Protective Covenants and Restrictions,
as set out in instrument recorded April 2, 1965 in Volume 584
page 493 of the Deed Records of Jackson County, Oregon.
3. Agreement and consent to improvements of streets and
costs in connection therewith, as set out in instrument
recorded May 5, 1972 as No. 72-05665 of the Official Records of
Jackson County, Oregon.
4. An easement 5.0 feet in width, to install, operate and
maintain for communication purposes an underground coaxial
cable and the facilities and appurtenances incidental thereOf,
and rights and agreements in connection therewith, granted to
Southern Oregon Broadcasting Company, an Oregon corporation,
dba SO Cable TV, by instrument recorded March 14, 1977 as No.
77-04865 of the Official Records of Jackson County, Oregon, and
re-recorded March 24, 1977 as No. 77-05656, said Official
Records.
The true and actual consideration for this transfer is
$70,000.00.
