True and Actual Consideration:
PERMANENT UTILITY AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct,
install, use, operate, inspect, repair, maintain and remove .and replace public utilities
and a public pedestrian easement and sidewalk across, along and upon the real
property described below and further referred to in this easement agreement as the
"easement area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantors shall have the right to use the easement area for all
purposes not inconsistent with the uses and purposes of the property, provided that
Grantors shall not build or erect any structure upon the easement area without the prior
written consent of Grantee.

PUBLIC UTILITY AND PEDESTRIAN ACCESS EASEMENT
Commencing at the Southwest corner of Lot 1 of the Railroad Village Subdivision, a
Commercial Subdivision, to the City of Ashland, Jackson County, Oregon as now
recorded, situated in Donation Land Claim No. 42 in the Northeast Quarter of Section 9,
Township 39 South, Range 1 East of the Willamette Base and Meridian, Jackson
County, Oregon;
Thence South 740 09' 08" East, 121.62 feet; thence along the arc of a curve to the left
having a radius of 20.00 feet and an arc length of 31.42 feet, the long chord of which
bears North 60050' 32" East, 28.29 feet; thence North 740 09' 08" West, 6.00 feet;
thence South 150 50' 52" West, 7.00 feet; thence North 740 09' 08" West, 135.62 feet to
the Northwesterly boundary line of said Lot 1; thence South 150 50' 52" West along said
Northwesterly boundary line, 13.00 feet to the point of beginning.
