PERMANENT DRAINAGE EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace storm drainage facilities including but
not limited to, pipelines, water courses and drainage structures on real property described below
and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon, and is described as follows:
See the attached Exhibit A.
2. Use of surface. Grantors shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantors shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the easement area for the purposes connected with this
easement.
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such public utility facilities are constructed, maintained, replaced, reconstructed, or
removed, provide Grantors reasonable notice and restore the premises of the Grantors, and any
buildings or improvements disturbed by Grantee, as near as practicable.
5. Termination. All rights hereunder shall cease if and when the easement area ceases to be
used for public utility purposes.
6. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

10 FOOT WIDE DRAINAGE EASEMENT
Jarvis Living Trust to the City of Ashland
A 10.00 foot wide easement located 5.00 feet on each side of the following described centerline:
Commencing at the Southwest comer of Lot 7, Block 3 of TIMBERLINE SUBDIVISION
according to the official plat thereof, now of record in Jackson County, Oregon; thence along the
East right-of-way line of Timberline Terrace, South 00003' 46" East, 24.01 feet to intersect the
center of an existing 15" PVC storm sewer for the TRUE POINT OF BEGINNING; thence South
73047' East, 13.67 feet to the Southeast end of said PVC storm sewer; thence along the
existing drain ditch, South 690 45' 03" East, 17.39 feet; thence along said existing drain ditch
South 36046' 55" East, 23.05 feet; thence along said drain ditch South 37026' 04" East, 35.01
feet to intersect the center of a natural drainage draw; thence along said natural drainage draw
North 360 20' 20" East, 64.34 feet; thence along said natural drainage draw North 630 45' 50"
East, 33.71 feet; thence along said natural drainage draw North 530 38' 25" East, 22.59 feet to
intersect the South line of Lot 6 of said Block 3 (from which the Southwest comer of said Lot 6
bears North 890 59' 38" West, 45.39 feet).
The right-of-way boundaries are to extend to the East right-of-way line of Timberline Terrace at
the West end of the easement and extend to the Southerly line of Lot 6 at the East end of the
easement.
EXCEPTING THERFROM that portion of aforesaid easement that lies within the outside
boundaries of said TIMERLlNE SUBDIVISION.
